RELATING TO LAW ENFORCEMENT; REQUIRING A LAW ENFORCEMENT AGENCY TO PROVIDE ARREST RECORD INFORMATION REGARDING A JUVENILE TO THE PRINCIPAL OF THE SCHOOL THAT THE JUVENILE ATTENDS; AUTHORIZING DISCIPLINARY MEASURES BASED UPON THE ARREST RECORD INFORMATION; ENACTING A NEW SECTION OF THE ARREST RECORD INFORMATION ACT; ENACTING A NEW SECTION OF THE PUBLIC SCHOOL CODE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. A new section of the Arrest Record Information Act is enacted to read:
"[NEW MATERIAL] ARREST RECORD INFORMATION REGARDING A JUVENILE--DUTY TO REPORT INFORMATION TO THE PRINCIPAL OF THE SCHOOL THAT THE JUVENILE ATTENDS.--If a juvenile is charged with allegedly committing a criminal offense, the appropriate law enforcement agency shall provide arrest record information regarding the juvenile to the principal of the school that the juvenile attends."
Section 2. A new section of the Public School Code is enacted to read:
"[NEW MATERIAL] ARREST RECORD INFORMATION--PRINCIPAL MAY USE INFORMATION TO DISCIPLINE A STUDENT.--When a principal of a public school receives arrest record information regarding a juvenile who attends the principal's school, pursuant to the provisions of the Arrest Record Information Act, the principal may use the arrest record information to impose disciplinary measures against the juvenile."
