RELATING TO DISTRICT ATTORNEYS; INCREASING THE SALARIES OF DISTRICT ATTORNEYS; MAKING AN APPROPRIATION; DECLARING AN EMERGENCY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. Section 36-1-6 NMSA 1978 (being Laws 1976 (S.S.), Chapter 18, Section 1, as amended) is amended to read:
"36-1-6. DISTRICT ATTORNEYS--SALARIES.--
A. [Except as provided in Subsection B of this
section] For fiscal year 2000, district attorneys who serve in
a district that does not include a class A county within the
district shall receive an annual salary of [seventy thousand
two hundred sixty-five dollars ($70,265)] seventy-four
thousand four hundred eighty-one dollars ($74,481) and [B.]
district attorneys who serve in a district that includes a
class A county within the district shall receive an annual
salary of [seventy-three thousand nine hundred sixty-three
dollars ($73,963)] seventy-eight thousand four hundred one
dollars ($78,401).
B. For fiscal year 2001 and all subsequent fiscal years, the annual salary for district attorneys shall be established by the legislature in an appropriations act."
Section 2. APPROPRIATION.--Seventy-four thousand four hundred seventy-eight dollars ($74,478) is appropriated from the general fund to the administrative office of the district attorneys for expenditure in fiscal year 2000 for the purpose of paying salaries and benefits for district attorneys. Any unexpended or unencumbered balance remaining at the end of fiscal year 2000 shall revert to the general fund.
Section 3. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
