44TH LEGISLATURE - STATE OF NEW MEXICO - FIRST SESSION, 1999
PROPOSING TO AMEND ARTICLE 8 OF THE CONSTITUTION OF NEW MEXICO BY ADDING A NEW SECTION TO LIMIT THE USE OF REVENUES FROM STATE TAXES AND FEES IMPOSED ON THE SALE, USE OR RECEIPT OF GASOLINE AND OTHER MOTOR FUELS.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. It is proposed to amend Article 8 of the constitution of New Mexico by adding a new section to read:
"Revenue from state taxes or fees imposed on the sale of or for the privilege of using or receiving gasoline and any other fuel used to generate power to propel a motor vehicle shall be used solely for appropriation by the legislature to the state highway and transportation department or its successor agency for highway or transportation purposes or for distribution to municipalities or counties."
Section 2. The amendment proposed by this resolution shall be submitted to the people for their approval or rejection at the next general election or at any special election prior to that date which may be called for that purpose.
