Synopsis of Bill



Senate Bill 712 establishes procedures for the administration of depo-provera contraceptive injections to women who give birth for the second time to a drug-addicted baby. The bill requires the Department of Health to establish procedures for identifying these women and for petitioning the district court in order to gain an order that would implement the provisions of this bill. If a woman gave birth for a third time to a drug-addicted baby, the department would be required to petition the district court for an order to sterilize the woman.



Significant Issues



This bill may violate the rights of women to bear children.



ADMINISTRATIVE IMPLICATIONS



The Department of Health must bear the cost of depo-provera. The cost of this drug is not thought to be a significant cost.



TECHNICAL ISSUES



This bill may raise constitutional issues.
