SUMMARY
Synopsis of Bill
Senate Bill 551 would reauthorize the New Mexico Livestock Board for ten more years, with an additional one year delayed repeal.
Significant Issues
In accordance with the Sunset Act (Chapter 12, Article 9 NMSA 1978), the Legislative Finance Committee is responsible for holding a public hearing prior to the termination of any agency subject to the Sunset Act and is required to submit legislation for continuation of the agency as an amendment to the delayed repeal section covering creation of the agency and its related statutes.
The sunset process is an integral element to legislative oversight that ensures accountability of self-regulating professions. During the 1998 sunset review process, the LFC sunrise/sunset subcommittee reviewed the performance of Livestock Board and found its operation crucial to the State of New Mexico.
FISCAL IMPLICATIONS
Senate Bill 551 does not contain an appropriation. Should this bill or one of its duplicates pass and be enacted, the state would be required to make an annual appropriation to the board for its operations, which is consistent with the budget process.
ADMINISTRATIVE IMPLICATIONS
There would be no administrative impact from enactment of Senate Bill 551.
CONFLICT/DUPLICATION/COMPANIONSHIP/RELATIONSHIP
Senate Bills 341 and 380 would also reauthorize this board, but for only six years, with the one year delayed repeal.
OTHER SUBSTANTIVE ISSUES
If this bill, or one of its duplicates does not pass and be enacted, the Livestock Board would have one year to conclude its affairs and close its operations.
