SUMMARY
Synopsis of Amendment
The amendment to Senate Bill 135 adds a definition section for force or coercion, great mental anguish, patient, personal injury, psychotherapist, and spouse.
In addition, the amendment deletes the term " in a position of authority over the child," and replaces it with:
as part of the detail.
Finally, the amendment makes the same change as number one from above, but for third degree Criminal Sexual Contact of a Minor.
Synopsis of Bill
Senate Bill 135 seeks to amend Section 30-9-11 NMSA 1978 by expanding the definition of a child from ages thirteen to eighteen in cases of criminal sexual penetration in the second degree. Currently, the statute defines children as persons between the ages of thirteen and sixteen in second degree cases.
