SUMMARY
Synopsis of Bill
Senate Bill 116 would amend Section 13-17-1 NMSA 1978 to provide municipalities with the authority to adopt curfew ordinances. Conviction under such an ordinance would result in a fine of not more than $250.00, community service, or both. Additionally, the magistrate court would have concurrent jurisdiction with the municipal and metropolitan court for the purposes of this section.
Significant Issues
Senate Bill 116 would also amend the Children's Code to add original and exclusive jurisdiction to municipal, magistrate and metropolitan courts for municipal curfew violations. Incarcerating a child found guilty of any motor vehicle violations or municipal curfew violations in a municipal, magistrate or metropolitan court would require the prior approval of the children's court (district court).
