SUMMARY
Synopsis of Bill
House Bill 840 repeals Section 27-2B-20 NMSA 1978, which is the children's trust fund portion of the New Mexico Works Act (Act). As written, this section of the law requires the Human Services Department (Department) to set aside one-third of its share of child support collections to create trust funds for children of participants of the Act. The department is required to develop regulations for governing the trust.
Significant Issues
The Department has not yet implemented this program. Therefore, there are no general fund savings derived from House Bill 840.
FISCAL IMPLICATIONS
Should the Department implement this program, it projects it approximately $1,400.0 to administer and operate. This amount includes roughly $100.0 to hire three additional FTE to administer the trust funds. Therefore, in order for the Child Support Enforcement Division to continue to meet its other statutory requirements, these revenues will need to be supplanted by the general fund. The Department will also need to enhance the child support enforcement computer system to conform to new requirements. The cost of such changes are unknown.
ADMINISTRATIVE IMPLICATIONS
The Department is required to create and track all trust fund accounts.
