SUMMARY



Synopsis of Bill



House Bill 773 attempts to amend the current NMSA 1978 at 66-5-29 and 66-8-111 to change the one year period of license revocation for a first or subsequent DWI offense to a five year license revocation. In addition, the license revocation would apply if the individual refused to submit to the chemical test. Also, the revocation applies to persons convicted of shooting a firearm from a motor vehicle.



Significant Issues



Subsection B of Section 66-5-29 NMSA 1978 would be amended to read a person convicted of an offense rendering that person a "first offender" or "subsequent offender" pursuant to Subsection A, shall have his/her license revoked for a period of five years. If House Bill 773 were enacted, it would not effect current law which allows for first time DWI offenders to receive a limited license.



FISCAL IMPLICATIONS



There is no appropriation contained within this bill. However, the Administrative Office of the Courts has identified a $0.4 cost for statewide update, distribution, and documentation of statutory changes.
