Synopsis of HCPAC Amendment

The House Consumer and Public Affairs Committee amended House Bill 771 to add a new section regarding the retention and production of records by Medicaid managed care providers. More specifically the providers will be required to retain medical and business records for six years and provide copies or allow for inspection of those records upon request. The request no longer has to be made in writing.

Synopsis of Bill

House Bill 771 amends the Medicaid Provider Act to strike language requiring the Human Services Department Secretary to provide in writing a seven days' notice of an investigation or administrative proceeding.

Significant Issues

Removing the seven days' notice from the Medicaid Provider Act will equip the Human Services Department with a needed tool in investigating fraud and abuse. The seven days' notice for a provider allows sufficient time for providers to alter and/or destroy records relevant to pending investigations.
