SUMMARY



Synopsis of Bill



House Bill 743 expands the existing definition of traditional historic communities to include all unincorporated areas, regardless of population, subject to other restrictions for the purpose of controlling the ability on municipalities to annex such a community. The bill also allows a board of county commissioners to declare an area as a traditional historic community if through a petition process a declaration is signed by a majority of the qualified electors residing in the area proposed to be a traditional historic community. A new section is also being proposed that would provide for a petition process to the county commissioners whereby a majority of landowners within a historic community, excluding federal and state properties, may request imposing assessments against the real property in the community to pay for the cost of necessary improvements.



FISCAL IMPLICATIONS



A review of House Bill 743 indicates no fiscal impact should result from passage of this measure; therefore, an in-depth analysis of technical and other issues has not been conducted by the staff.
