Synopsis of HJC Amendment
House Judiciary Committee amendment for House Bill 492 strikes all of Section 1.B. which removes
the provision that speaks to negligence of a health care provider and his liability for damages proximately caused by the negligent treatment.
Synopsis of Bill
House Bill 492 delineates authority for health care providers to provide prenatal, delivery and postnatal care to a female minor. The bill also provides that a female minor has the capacity to consent to prenatal, delivery and postnatal care by a licensed health care provider. Finally, the bill provides for the liability of a health care provider who provides care in a negligent manner.
Significant Issues
House Bill 492 allow minor females to give consent for prenatal, delivery and postnatal care from health care providers operating within the scope of their practice.
