SUMMARY



Synopsis of Bill



House Bill 474 requires the General Services Department to lease the old campus of the Los Lunas Hospital and training center to the Los Lunas School District for a period of five years. The school district is required to have the property re-surveyed, and to provide the survey and legal description to the Department within the term of the lease.



Significant Issues



According to the Attorney General, to the extent this bill requires GSD to enter into this lease, it may violate the separation of powers doctrine. Legislative ratification and approval is only necessary when a lease term exceeds 25 years and the consideration is greater than $100.0, which is not this case.



FISCAL IMPLICATIONS



According to GSD, the Public Buildings Repair Fund would lose potential rent payments and the Property Control Reserve Fund would lose revenue from potential property sale.



ADMINISTRATIVE IMPLICATIONS



The Department indicates that any administrative functions relating to this bill could be absorbed within their existing capacity.
