Synopsis of SPAC Amendment
Senate Public Affairs Committee amendment to House Judiciary Committee substitute for House Bill 473 does the following: On page 4, line 19, strikes the phrase "health facility" and inserts the new phrase to now read, "transportation provider".
Synopsis of Bill
House Judiciary Committee substitute for House Bill 473 establishes guidelines to be promulgated by the Department of Health and the Public Regulation Commission after consultation with the transportation programs bureau of the State Highway and Transportation Department that deal with wheelchair safety. The bill further requires both the department and the commission distribute these guidelines to all health care facilities and appropriate transportation companies. Facilities and companies are required to submit listings of those employees that have received training, and health facilities will be evaluated on compliance with these guidelines at the time of their annual inspection for licensure as a health facility. An administrative penalty of up to $5,000.00 is allowed for the first offense and a $10,000.00 administrative penalty is allowed for a second offense. Further more stringent penalties are allowed for subsequent offenses.
FISCAL IMPLICATIONS
Additional monies are reported necessary for the Public Regulation Commission to administer the provisions of the act.
