SUMMARY
Synopsis of Amendment
The House Judiciary amendment to House Bill 440 strikes retired state or federal judges from carrying concealed deadly weapons. All other analysis still applies.
Synopsis of Bill
House Bill 440 would amend Section 30-7-2 NMSA 1978 to permit active or retired state and federal judges to carry concealed, loaded firearms or other types of deadly weapons anywhere upon completion of a firearms instruction course.
Significant Issues
House Bill 440 would maintain that carrying a loaded concealed weapon is legal in the following situations: in a person's residence or property belonging to him or her as a lessee, tenant or licensee; in a private automobile for personal protection; employed as a peace officer; by a peace officer who is a temporary employee; and by an active or retired state or federal judge who has successfully completed a course in firearms instruction. The course in firearms instruction shall be taught by any of the following entities: the New Mexico Law Enforcement Academy, the National Law Enforcement and Training Center; or a certified firearms instructor.
If a person unlawfully carries a concealed weapon, they are guilty of a misdemeanor.
ADMINISTRATIVE IMPLICATIONS
The AOC would be required to maintain records and issue appropriate identification to the judges who have completed the prescribed training.
