Synopsis of HJC Amendment



The amendment to House Bill 438 strikes the Attorney General from the list of agencies that the Legislature must provide staffing and resources when it creates a new criminal judgeship.



Synopsis of Bill



House Bill 438 requires the legislature to provide necessary staffing and resources to the public defender department, the appropriate district attorney's office and the attorney general when it creates a new criminal judgeship. The bill also requires the Administrative Office of the Courts (AOC) to work with the public defender, district attorney and office of the attorney general to ensure that a unified proposal for necessary staffing is presented to the legislature when it considers the creation of a new criminal court judgeship.





Significant Issues



According to AOC, House Bill 438 legislates a process that is already in place and that AOC currently includes the needs of the district attorney, public defender and attorney general in its judgeship requests.



FISCAL IMPLICATIONS



House Bill 438 increases the costs to the general fund for any newly created criminal judgeship. The impact to the general fund is contingent upon the number of new judgeships created. AOC estimates that the inclusion of resources for the district attorney, public defender and attorney general roughly doubles the cost of a new judgeship.
