SUMMARY
Synopsis of Bill
Adding a new section to the Pharmacy Act, House Bill 380 would remove the Board of Pharmacy from under the administration of the Regulation and Licensing Department (RLD), thus creating it as an independent board.
Significant Issues
Executive Order 86-10, pursuant to the legislative authority in Chapter 297 of Laws of 1983, consolidated boards and commissions under the newly created Regulation and Licensing Department, which formerly was the Commerce and Industry Department. The purpose for the consolidation was to gain efficiencies and reduce duplication in the administration of the numerous boards or commissions within state government.
Since this time, some boards or commissions have been removed from within RLD and have become independent. Examples include the Board for Examiners for Architects on the Board of Nursing.
FISCAL IMPLICATIONS
House Bill 380 does not contain an appropriation. The Board of Pharmacy has stated that it currently handles all of its administrative tasks, with little or no assistance from the RLD. The Board of Pharmacy, however, may encounter a series of new administrative costs because of the transfer from RLD to an independent agency.
The RLD has recently completed development of a Y2K compliant computer licensing computer system for use by all boards and commissions. The Board of Pharmacy would be required to purchase a duplicate system.
ADMINISTRATIVE IMPLICATIONS
The administrative implications would be relatively minor for both the department and the Board of Pharmacy.

House Bill 380 duplicates Senate Bill 281. The bill relates to House Bill 381.
