Synopsis of Bill
House Bill 234 would amend Section 66-8-101 NMSA 1978 to include homicide by vehicle while under the influence of intoxicating liquor or other drugs (or while violating Section 66-8-113 NMSA 1978) as a third degree felony resulting in the death of a human being. Persons convicted of homicide by vehicle while under the influence will be sentenced pursuant to Section 31-18-15 NMSA 1978.
Significant Issues
House Bill 234 also changes the language "great bodily injury" to "great bodily harm".
