SUMMARY
Synopsis of Bill
House Judiciary Committee substitute for House Bill 134 seeks to amend Section 29-11A-1 NMSA 1978 to expand the list of sex offenses under the Sex Offenses Registration Act to include solicitation to commit any of the acts enumerated sex offenses. The substitution removes kidnaping from the list of definitions. Also, the substitute adds to the list of offenses the "solicitation to commit criminal sexual contact of a minor in the third and fourth degree" and "attempt to commit any of the sex offenses" set forth in the definitions subsection of the act. The bill adds the word "Notification" to the act's title. Additionally, sex offenders who are residents of other states but work or attend school in New Mexico would be required to register ( and annually renew registration) with the sheriff of the county in which they work or attend school. The bill provides that the Department of Public Safety will participate in the National Sex Offender Registry. Finally, the public would be allowed access to registration information regarding sex offenders convicted of crimes listed in the act. Registration information could be obtained from the county sheriff, municipal law enforcement, or the district attorney.
Significant Issues
HJC substitute for House Bill 134 would become effective July 1, 1999 if passed.
ADMINISTRATIVE IMPLICATIONS
This bill would require the Department of Public Safety to participate in the National Sex Offender Registry.
