Synopsis of Bill



House Bill 5 appropriates funds for the operations of the Supreme Court Law Library, New Mexico Compilation Commission, Judicial Standards Commission, Court of Appeals, Supreme Court, Administrative Office of the Courts, Supreme Court Building Commission, District Courts, and Bernalillo County Metropolitan Court.



Significant Issues



This bill represents the LFC recommendation.



FISCAL IMPLICATIONS



The general fund fiscal impact is $70,804.5 for state court units, district courts and Bernalillo County Metropolitan court. This appropriation is a decrease of $65.9 (0.1 percent) from FY99.



The other state funds portion of the budget is $1,116.0 for the New Mexico Compilation Commission, $3,046.3 for the Supreme Court Automation fund, $865.5 for the Municipal Court Automation fund, $40.0 for judges pro tempore, $1,546.0 from the Magistrate and Metropolitan Court Facilities Fee fund for the magistrate courts, $872.2 for the Magistrate Court Warrant Enforcement fund, $951.1 for the 13 judicial districts and $1,737.9 for the Bernalillo County Metropolitan court.



The internal service funds/interagency transfers are $600.0 for the Jury and Witness Fee fund and $1,003.6 for the 13 judicial districts.



The federal funds are $19.4 for victims assistance in the Eleventh judicial district.



ADMINISTRATIVE IMPLICATIONS



House Bill 5 funds base court operations for FY2000. Per LFC guidelines, the bill does not include 18 positions that were vacant three months or longer as of September 4, 1998.



Funding for a salary reclassification authorized by the Supreme Court is not included in the bill.



RELATIONSHIP/DUPLICATION



Appropriations will still be made to judicial units in House Bill 2. This bill does not preclude House Bill 2 appropriations.



House Bill 5 duplicates Senate Bill 5.



OTHER SUBSTANTIVE ISSUES



House Bill 5 represents the base LFC recommendation for court operations. Also included in the bill are appropriations to create or expand drug court programs in districts around the state, and additional FTE to offset workload increases in the Second District and at the Bernalillo County Metropolitan Court.
