RELATING TO GAME AND FISH; AUTHORIZING THE STATE GAME COMMISSION TO NEGOTIATE FOR THE PURCHASE OF THE EAGLE NEST LAKE, DAM AND THE SURROUNDING LAND; AUTHORIZING THE DISPOSITION OF CERTAIN LAND; PROVIDING LEGISLATIVE AUTHORIZATION TO THE NEW MEXICO FINANCE AUTHORITY TO ISSUE BONDS FOR A PORTION OF THE PURCHASE PRICE; MAKING AN APPROPRIATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. EAGLE NEST LAKE--NEGOTIATION AND PURCHASE--USE.--
A. The state game commission shall:
(1) negotiate, on behalf of the state, for the purchase of the Eagle Nest lake, dam and the surrounding land; and
(2) upon completion of successful negotiations, certify to the secretary of finance and administration that the negotiations have been successful and that the purchase price agreed to, including the value of any land to be exchanged by the state, is no higher than the appraised value.
B. In negotiating the purchase pursuant to Subsection A of this section, the state game commission may:
(1) agree to trade property owned by the state game commission as a portion of the purchase price; and
(2) agree to expend the appropriations made in Sections 2 and 3 of this act, or so much of the appropriations as are necessary, as a portion of the purchase price.
C. If the negotiations and purchase pursuant to this section are successful, the property control division of the general services department shall own and maintain the lake, dam and the surrounding lands with management by the department of game and fish, the state parks division of the energy, minerals and natural resources department and the interstate stream commission.
Section 2. NEW MEXICO FINANCE AUTHORITY--AUTHORIZATION OF PROJECT.--Pursuant to the provisions of Section 6-21-6 NMSA 1978, the legislature authorizes the New Mexico finance authority to issue bonds payable from the public project revolving fund in an amount not to exceed nine million dollars ($9,000,000) for the purpose of making a grant of the proceeds of the bonds to the state game commission. The net proceeds of the bonds are appropriated to the state game commission for expenditure in fiscal year 2000 for the appraisal and purchase of the Eagle Nest lake, dam and the surrounding lands. Any unexpended or unencumbered balance remaining at the end of fiscal year 2000 shall revert to the public project revolving fund.
Section 3. APPROPRIATION.--Two million dollars ($2,000,000) is appropriated from the game protection fund to the state game commission for expenditure in fiscal year 2000 for the purchase of Eagle Nest lake, dam and the surrounding lands. Any unexpended or unencumbered balance remaining at the end of fiscal year 2000 shall revert to the game protection fund.
