AN ACT

RELATING TO CRIMINAL LAW; REVISING THE ELEMENTS OF THE CRIMINAL OFFENSE KNOWN AS ESCAPE FROM JAIL; AMENDING A SECTION OF THE NMSA 1978.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. Section 30-22-8 NMSA 1978 (being Laws 1963,

Chapter 303, Section 22-8) is amended to read:

"30-22-8. ESCAPE FROM JAIL.--

A. Escape from jail consists of: [any]

(1) a person who [shall have] has been lawfully committed to [any] a jail escaping or attempting to escape from [such] the jail; or

(2) a person, excluding a person on probation, who has been lawfully committed to a judicially approved community custody program, including a day reporting program, an electronic monitoring program, a day detention program or a community tracking program, escaping or attempting to escape from the program.

B. Whoever commits escape from jail is guilty of a fourth degree felony."

Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 1999.
