RELATING TO MOTOR TRANSPORTATION; ALLOWING THE USE OF PHOTORADAR TO IDENTIFY COMMERCIAL MOTOR VEHICLES THAT EXCEED THE POSTED SPEED LIMIT AND THE MAILING OF PENALTY ASSESSMENT MISDEMEANORS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. MOTOR TRANSPORTATION--PHOTORADAR OF COMMERCIAL MOTOR VEHICLES.--The motor transportation division of the department of public safety shall establish a photoradar speeding program for trucks over twenty-six thousand pounds. When photoradar identifies a truck that is exceeding the posted speed limit, the department shall mail to the owner of the truck, as evidenced by the registration, a uniform traffic citation charging the owner with a penalty assessment misdemeanor. If the owner chooses the notice-to- appear option on the penalty assessment misdemeanor, he shall notify the motor transportation office from which the assessment was written.
