0011|     PROPOSING AN AMENDMENT TO ARTICLE 4 OF THE CONSTITUTION OF NEW

0012|     MEXICO TO PROVIDE A REVISED ELECTION CYCLE FOR MEMBERS OF THE

0015|     BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  It is proposed to amend Article 4, Section 4
    |
0017|     of the constitution of New Mexico to read:
    |
0018|               "<u>A.</u>  Members of the legislature shall be elected
    |
0019|     as follows:  <s>[those senators from Bernalillo, Chaves, Curry,
</s>    |
<s></s>0020| <s>    DeBaca, Grant, Lea, Lincoln, Luna, Sandoval, San Juan, San
</s>    |
<s></s>0021| <s>    Miguel, Socorro, Taos, Torrance, Union and Valencia counties
</s>    |
<s></s>0022| <s>    for a term of six years starting January 1, 1961, and after
</s>    |
<s></s>0023| <s>    serving such terms shall be elected for a term of four years
</s>    |
<s></s>0024| <s>    thereafter; those senators from all other counties for the
</s>    |
<s></s>0025| <s>    terms of four years, and]</s>

0001|                    <u>(1)  members of the senate elected at the
</u>    |
<u></u>0002| <u>    general election in 2000 shall be divided by lot, in a manner
</u>    |
<u></u>0003| <u>    determined by the senate, into two classes of twenty-one seats
</u>    |
<u></u>0004| <u>    in each class.  Members of the senate in class one shall be
</u>    |
<u></u>0005| <u>    elected for a term of two years at the general election in
</u>    |
<u></u>0006| <u>    2000 and after serving the two-year term shall be elected for
</u>    |
<u></u>0007| <u>    a term of four years at subsequent elections.  Members of the
</u>    |
<u></u>0008| <u>    senate in class two shall be elected for a term of four years
</u>    |
<u></u>0009| <u>    at the general election in 2000 and in subsequent elections;
</u>    |
<u></u>0010| <u>    and
</u>    |
<u></u>0011| <u>                   (2)</u>  members of the house of representatives
    |
0012|     <u>shall be elected</u> for a term of two years.  <s>[They]</s>
    |
0013|               <u>B.  Members of the legislature</u> shall be elected
    |
0014|     on the day provided by law for holding the general election of
    |
0015|     state officers or representatives in congress.
    |
0016|               <u>C.</u>  If a vacancy occurs in the office of senator
    |
0017|     or member of the house of representatives, for any reason, the
    |
0018|     county commissioners of the county wherein the vacancy occurs
    |
0019|     shall fill such vacancy by appointment.
    |
0020|               <u>D.</u>  Such legislative appointments as provided in
    |
0021|     this section shall be for a term ending on December 31,
    |
0022|     subsequent to the next succeeding general election."
    |
0023|          Section 2.  The amendment proposed by this resolution
    |
0024|     shall be submitted to the people for their approval or
    |
0025|     rejection at the next general election or at any special
    |
