0011| PROPOSING A LONG-TERM LEASE OF THE PENITENTIARY OF NEW
|
0012| MEXICO'S WASTEWATER TREATMENT PLANT TO SANTA FE COUNTY.

0014| WHEREAS, Section 13-6-3 NMSA 1978 requires ratification
|
0015| and approval of any sale, trade or lease of state property
|
0016| over one hundred thousand dollars ($100,000) in value; and
|
0017| WHEREAS, the property control division of the general
|
0018| services department is desirous of leasing the penitentiary of
|
0019| New Mexico's wastewater treatment plant to Santa Fe county for
|
0020| a period not to exceed ninety-nine years; and
|
0021| WHEREAS, the lease is contingent on Santa Fe county
|
0022| providing free wastewater treatment services to state
|
0023| agencies, including the penitentiary and other state buildings
|
0024| occupied at present by the corrections department and the
|
0025| department of military affairs; and
|

0001| WHEREAS, the real property, with improvements, is more
|
0002| particularly described as follows:
|
0003| A certain tract of land within Santa Fe
|
0004| County, New Mexico, being a portion of the South
|
0005| half of Section 34, T.16N., R.8E., N.M.P.M., and
|
0006| being more particularly described by metes and
|
0007| bounds as follows:
|
0008| BEGINNING at the Southwesterly corner of the
|
0009| tract marked by a U.S.G.L.O. stone monument marking
|
0010| the Section Corner common to Sections 33 and 34,
|
0011| T.16 N., R.8E. and Sections 3 and 4, T.15 N., R.8
|
0012| E.; thence,
|
0013| N00 10'51"E, 2089.28 feet to a calculated
|
0014| point on the I-25 frontage road right-of-way;
|
0015| thence, along said right-of-way,
|
0016| N51 17'58"E, 884.09 feet to a Koogle and

0017| Pouls capped rebar, Surveyor #4076; thence,

0018| leaving said right-of-way,
|
0019| N89 38'04"E, 1947.08 feet to a 3" pipe,

0020| being the center of Section 34; thence,

0021| N89 37'10"E, 2582.44 feet to a U.S.G.L.0.

0007| Containing 313.275 acres, more or less.

0008| All as shown on that certain plat of survey

0009| titled "State of New Mexico, State Armory Board,

0010| New Mexico National Guard Armory, within Section

0011| 34, T.16 N., R.8E., N.M.P.M., Santa Fe County, New

0012| Mexico", dated June, 1987 by Richard E. Smith,

0013| NMPLS #5837, as filed for record on June 30, 1987

0014| in the office of the Santa Fe County Clerk in Book
|
0015| 175 at Page 001, as Reception #626,050.

0016| Provided, however, that the State of New

0017| Mexico shall retain a right-of-way easement along
|
0018| former State Road NMSHD R/W Project No. SP 2536
|
0019| (800), consisting of 13.877ñ acres, as shown on the
|
0020| above-referenced plat.

0021| Subject to reservations, restrictions, and/or

0022| easements of record.;

0023| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0024| STATE OF NEW MEXICO that the proposed lease be hereby ratified
|
0025| and approved pursuant to the provisions of Section 13-6-3 NMSA
|

|
0002| BE IT FURTHER RESOLVED that a copy of this resolution be
|
0003| transmitted to the property control division of the general
|
0004| services department.
