0011|     PROPOSING TO AMEND ARTICLE 11, SECTION 1 OF THE CONSTITUTION

0012|     OF NEW MEXICO TO PROVIDE FOR APPOINTMENT OF PUBLIC REGULATION

0013|     COMMISSION MEMBERS.

0015|     BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  It is proposed to amend Article 11, Section 1
    |
0017|     of the constitution of New Mexico to read:
    |
0018|          "The "public regulation commission" is created.  The
    |
0019|     commission shall consist of five members <s>[elected from
</s>    |
<s></s>0020| <s>    districts provided by law]</s> <u>appointed</u> for staggered four-
    |
0021|     year terms <s>[beginning on January 1 of the year following
</s>    |
<s></s>0022| <s>    their election; provided that those chosen at the first]</s>. 
    |
0023|     <u>Members elected at the 1998</u> general election <s>[after the
</s>    |
<s></s>0024| <s>    adoption of this section]</s> shall immediately classify
    |
0025|     themselves by lot, so that two of them shall hold office for
    |

0001|     two years and three of them for four years <s>[and further
</s>    |
<s></s>0002| <s>    provided that, after serving two terms, members shall be
</s>    |
<s></s>0003| <s>    ineligible to hold office as a commission member until one
</s>    |
<s></s>0004| <s>    full term has intervened.  No commissioner or candidate for
</s>    |
<s></s>0005| <s>    the commission shall accept anything of value from a person or
</s>    |
<s></s>0006| <s>    entity whose charges for services to the public are regulated
</s>    |
<s></s>0007| <s>    by the commission]</s>, <u>and thereafter the members shall be
</u>    |
<u></u>0008| <u>    appointed by the governor and confirmed by the senate.  The
</u>    |
<u></u>0009| <u>    legislature shall provide by law for the ethical conduct of
</u>    |
<u></u>0010| <u>    the members</u>." 
    |
0011|          Section 2.  The provisions of this amendment shall take
    |
0012|     effect January 1, 1999.
    |
0013|          Section 3.  The amendment proposed by this resolution
    |
0014|     shall be submitted to the people for their approval or
    |
0015|     rejection at the next general election or at any special
    |
0016|     election prior to that date which may be called for that
    |
0017|     purpose.
