0001| SENATE MEMORIAL 28 | 0002| 43RD LEGISLATURE - STATE OF NEW MEXICO - SECOND SESSION, 1998 | 0003| INTRODUCED BY | 0004| JOHN PINTO | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| A MEMORIAL | 0011| REQUESTING THE UNITED STATES DEPARTMENT OF TRANSPORTATION TO | 0012| USE FUNDS AUTHORIZED BY THE INTERMODAL SURFACE TRANSPORTATION | 0013| EFFICIENCY ACT OF 1991 FROM THE INDIAN ROADS CONSTRUCTION FUND | 0014| TO CONSTRUCT THE HOGBACK BRIDGE AND IMPROVE CONNECTING ROADS | 0015| NAVAJO 36A AND UNITED STATES HIGHWAY 64. | 0016| | 0017| WHEREAS, through various treaties and acts of congress, | 0018| the federal government has promised Indian nations, tribes and | 0019| pueblos certain goods and services, one of which is | 0020| transportation services, to serve the social and economic | 0021| needs of the Indian nations, tribes and pueblos; and | 0022| WHEREAS, Indian nations, tribes and pueblos are totally | 0023| dependent on the federal transportation programs for their | 0024| transportation needs because they are not eligible under | 0025| federal law to administer federal highway trust funds directly |

0001| or to receive a portion of fuel revenue collected on Indian | 0002| reservations for transportation purposes; and | 0003| WHEREAS, there is a critical need to improve | 0004| transportation services on the Indian reservations throughout | 0005| the United States to promote economic development, improve | 0006| health care, enhance education and increase employment; and | 0007| WHEREAS, the Indian nations, tribes and pueblos recognize | 0008| and appreciate the support the transportation programs have | 0009| contributed to the success of many social and economic | 0010| development efforts on all Indian reservations; and | 0011| WHEREAS, pursuant to the federal Surface Transportation | 0012| Assistance Act of 1982, the United States secretary of | 0013| transportation is to allocate funds authorized to be | 0014| appropriated for Indian reservation roads in accordance with | 0015| the relative needs of the various Indian reservations; | 0016| NOW, THEREFORE, BE IT RESOLVED BY THE SENATE OF THE STATE | 0017| OF NEW MEXICO that the United States department of | 0018| transportation be requested to use funds authorized by the | 0019| federal Intermodal Surface Transportation Efficiency Act of | 0020| 1991 from the Indian roads construction fund to construct the | 0021| Hogback bridge and improve Navajo 36A and United States | 0022| highway 64; and | 0023| BE IT FURTHER RESOLVED that copies of this memorial be | 0024| transmitted to the president of the United States, the New | 0025| Mexico congressional delegation, the United States secretary |
