0011|     REQUESTING THE NEW MEXICO LEGISLATIVE COUNCIL TO CREATE AN

0012|     INTERIM LEGISLATIVE COMMITTEE TO REVIEW THE IMPACTS OF
    |
0013|     SUBDIVISIONS AND SUBDIVISION LAWS.

0015|          WHEREAS, the 1995 New Mexico legislature substantially
    |
0016|     rewrote the New Mexico Subdivision Act, to be effective July
    |
0017|     1, 1996; and
    |
0018|          WHEREAS, the New Mexico Subdivision Act now requires each
    |
0019|     county to enact regulations governing subdivisions; and
    |
0020|          WHEREAS, the counties have exercised the right to
    |
0021|     regulate subdivisions in very different ways; and
    |
0022|          WHEREAS, the effect of the new law and the county
    |
0023|     regulations implementing the law on growth and development
    |
0024|     within New Mexico has not been assessed; and
    |
0025|          WHEREAS, it is necessary that the legislature become
    |

0001|     aware of any problems caused or associated with the new law
    |
0002|     and the positive or negative impacts caused by the law and by
    |
0003|     subdivisions in New Mexico; 
    |
0004|          NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF
    |
0005|     REPRESENTATIVES OF THE STATE OF NEW MEXICO that the New Mexico
    |
0006|     legislative council be requested to create a legislative
    |
0007|     interim committee to:
    |
0008|               A.  examine the statutes, constitutional
    |
0009|     provisions, regulations and court decisions governing
    |
0010|     subdivisions in New Mexico;
    |
0011|               B.  gather testimony and other information on the
    |
0012|     effects of the New Mexico Subdivision Act and county
    |
0013|     regulations implementing that act;
    |
0014|               C.  gather testimony and other information on the
    |
0015|     positive and negative effects associated with subdivisions;
    |
0016|     and
    |
0017|               D.  recommend legislation or changes, if any are
    |
0018|     found to be necessary, to the first session of the forty-
    |
0019|     fourth legislature; and
    |
0020|          BE IT FURTHER RESOLVED that a copy of this memorial be
    |
0021|     sent to each member of the New Mexico legislative council.
