0011| REQUESTING THE STATE PARK AND RECREATION DIVISION OF THE
|
0012| ENERGY, MINERALS AND NATURAL RESOURCES DEPARTMENT TO CONTINUE
|
0013| ITS MANAGEMENT AND OPERATION OF THE CORONADO STATE PARK.
|

|
0015| WHEREAS, Coronado state park is managed solely by the
|
0016| state park and recreation division of the energy, minerals and
|
0017| natural resources department and Coronado state monument is
|
0018| managed by the museum division of the office of cultural
|
0019| affairs; and
|
0020| WHEREAS, the state park and recreation division has
|
0021| proposed that the management of both facilities be the sole
|
0022| responsibility of the museum division; and
|
0023| WHEREAS, the director of the state park and recreation
|
0024| division summarily informed the director of the museum
|
0025| division in April 1997 that the facility would be transferred
|

0001| to the museum division in November of that year with certain
|
0002| park facilities closed or removed from the property; and
|
0003| WHEREAS, the director of the museum division has stated
|
0004| that his division is not able to support the decision to close
|
0005| the park or to transfer management of the facility because the
|
0006| division lacks the personnel, equipment and operating budget;
|
0007| and
|
0008| WHEREAS, a draft joint powers agreement was submitted to
|
0009| the museum division in October 1997; and
|
0010| WHEREAS, the park is a popular facility and provides
|
0011| economic benefit to Sandoval county and the town of Bernalillo
|
0012| and many park visitors and community leaders oppose the
|
0013| closure or transfer of the park; and
|
0014| WHEREAS, the attorney general's office has objected to
|
0015| the park's closure or transfer based on terms of a lease still
|
0016| in effect until the year 2042, the management authority
|
0017| pursuant to the enabling statutes of the respective agencies,
|
0018| the lack of legislative authorization for transference of
|
0019| appropriations and the lack of legislative authority for
|
0020| transference of property pursuant to Chapter 13, Article 6
|
0021| NMSA 1978 or personnel pursuant to Section 10-7-1 NMSA 1978;
|
0022| and
|
0023| WHEREAS, the state park and recreation division had
|
0024| asserted that the park no longer meets the division's criteria
|
0025| for a state park, and yet the state park and recreation
|

0001| division has not explained its criteria to the public; and
|
0002| WHEREAS, the state park and recreation division should
|
0003| conduct public hearings on any proposed closure or transfer of
|
0004| a state park in the future; and
|
0005| WHEREAS, private businesses and, therefore, the local
|
0006| economy may be hurt by the closure or improper and inadequate
|
0007| transfer of resources and operations of a state park as
|
0008| important and popular as Coronado state park; and
|
0009| WHEREAS, transfer or closure of the park may jeopardize
|
0010| the safety and security of the community and visitors to the
|
0011| area; and
|
0012| WHEREAS, this situation clearly supports the need for the
|
0013| legislature to re-establish a state park commission;
|
0014| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0015| STATE OF NEW MEXICO that Coronado state park continue to be
|
0016| managed and operated by the state park and recreation division
|
0017| of the energy, minerals and natural resources department
|
0018| pursuant to statutory authority and legislative
|
0019| appropriations; and
|
0020| BE IT FURTHER RESOLVED that any further discussions or
|
0021| plans for changing the operating conditions of the park be
|
0022| conducted and prepared forthrightly, properly and pursuant to
|
0023| law; and
|
0024| BE IT FURTHER RESOLVED that copies of this memorial be
|
0025| transmitted to the governor, the secretary of energy, minerals
|

0002| the attorney general.
