0011| REQUESTING THE OFFICE OF THE ATTORNEY GENERAL TO CREATE A TASK

0012| FORCE TO REVIEW POLICIES AND STATUTES REGARDING GUARDIANSHIP

0015| WHEREAS, guardianship services in the state are available
|
0016| for persons eighteen years of age and older who are
|
0017| decisionally incapacitated; and
|
0018| WHEREAS, a review of existing policies, procedures and
|
0019| regulations pertaining to guardianship services is necessary
|
0020| to ensure quality, cost-effectiveness and accountability; and
|
0021| WHEREAS, a review of the Uniform Probate Code pertaining
|
0022| to guardianship services is necessary in determining the best
|
0023| practices for guardianship services; and
|
0024| WHEREAS, representation of all parties interested in
|
0025| guardianship services should be included in a discussion of
|

0001| policies, procedures, regulations and existing statutory law
|
0002| regarding those services to formulate recommendations to
|
0003| improve the quality, cost-effectiveness and accountability of
|
0004| guardianship services available in the state of New Mexico;
|
0005| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0006| STATE OF NEW MEXICO that the office of the attorney general be
|
0007| requested to form a task force and coordinate a study to
|
0008| review and recommend revisions to policies, procedures and
|
0009| regulations pertaining to guardianship services and to suggest
|
0010| statutory changes to reflect those revisions; and
|
0011| BE IT FURTHER RESOLVED that the task force consist of
|
0012| family members of persons in need of guardianship services;
|
0013| community-based providers of developmental disability, mental
|
0014| health and aging services; the elder law section of the New
|
0015| Mexico bar association, advocacy organizations, the department
|
0016| of health, the human services department, the children, youth
|
0017| and families department, the state agency on aging, the
|
0018| administrative office of the courts and providers of
|
0019| guardianship services; and
|
0020| BE IT FURTHER RESOLVED that the office of the attorney
|
0021| general report its findings and recommendations, if any, to
|
0022| the appropriate legislative interim committee prior to the
|
0023| 1999 legislative session; and
|
0024| BE IT FURTHER RESOLVED that copies of this memorial be
|
0025| sent to the attorney general; the secretary of health, the
|

0001| secretary of human services, the secretary of children, youth
|
0002| and families, the director of the state agency on aging and
|
0003| the director of the administrative office of the courts.
