SANCHEZ | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| A MEMORIAL | 0011| REQUESTING THE STATE RACING COMMISSION TO CONDUCT A STUDY OF | 0012| THE DISTRIBUTION OF REVENUES GENERATED BY GAMING OPERATOR | 0013| LICENSEES THAT ARE RACETRACKS AND CONSIDER A PROPOSAL TO | 0014| DEDICATE A PORTION OF THOSE REVENUES TO THE JOCKEYS' GUILD | 0015| HEALTH AND WELFARE TRUST FUND. | 0016| | 0017| WHEREAS, live thoroughbred horse racing is conducted in | 0018| four communities in New Mexico; and | 0019| WHEREAS, thoroughbred horse racing provides entertainment | 0020| and economic development in those communities; and | 0021| WHEREAS, there are three essential participants in the | 0022| horse racing industry: track owners, horse owners and the | 0023| professional jockeys who race the horses; and | 0024| WHEREAS, professional jockeys assume risks every racing | 0025| day on behalf of track owners and horse owners; and | - 1 - 0001| WHEREAS, without the participation of the jockeys, | 0002| thoroughbred horse racing cannot take place; and | 0003| WHEREAS, the jockeys' guild is an organization that | 0004| represents a majority of professional jockeys in New Mexico, | 0005| and it manages a health and welfare trust fund on behalf of | 0006| its members; and | 0007| WHEREAS, the four thoroughbred racetracks in New Mexico | 0008| are also gaming operator licensees pursuant to the provisions | 0009| of the Gaming Control Act; and | 0010| WHEREAS, as set forth in Section 60-2E-47 NMSA 1978, a | 0011| gaming operator licensee that is a racetrack pays the | 0012| following: a gaming tax that is twenty-five percent of the | 0013| net take; twenty percent of the net take to purses that are | 0014| distributed in accordance with regulations adopted by the | 0015| state racing commission; and one-fourth of one percent of the | 0016| net take of gambling machines to fund programs for the | 0017| treatment and assistance of compulsive gamblers; | 0018| NOW, THEREFORE, BE IT RESOLVED BY THE SENATE OF THE STATE | 0019| OF NEW MEXICO that the state racing commission conduct a study | 0020| of the distribution of revenues generated by gaming operator | 0021| licensees that are racetracks and consider a proposal to | 0022| dedicate a portion of those revenues to the jockeys' guild | 0023| health and welfare trust fund; and | 0024| BE IT FURTHER RESOLVED that if the state racing | 0025| commission considers the proposal to have merit, that it | - 2 - 0001| prepare and recommend legislation to the first session of the | 0002| forty-fourth legislature; and | 0003| BE IT FURTHER RESOLVED that a copy of this memorial be | 0004| sent to the state racing commission and the New Mexico | 0005| horsemen's association. | 0006|  |
