Section 74-4F-3 NMSA 1978 (being Laws 1996, | 0018| Chapter 37, Section 3) is amended to read: | 0019| "74-4F-3. HAZARDOUS MATERIALS TRANSPORTATION PERMIT-- | 0020| DEPARTMENT DUTIES--FEES.-- | 0021| A. Except as provided in Section ~[4 of the | 0022| Hazardous Materials Transportation Act]~ |74-4F-4 NMSA 1978|, | 0023| a person may not transport a hazardous material on a state or | 0024| federal highway without a permit from the department. | 0025| B. The department shall establish regulations for | - 1 - 0001| the issuance of hazardous materials transportation permits and | 0002| shall issue permits to applicants who meet the requirements of | 0003| the regulations. | 0004| C. Hazardous materials transportation permits | 0005| shall be issued for a period not to exceed twelve months for a | 0006| fee of two hundred fifty dollars ($250), regardless of the | 0007| number of vehicles or combination of vehicles operated by the | 0008| permit applicant, or the department may issue a permit for a | 0009| single shipment of hazardous materials for a fee of seventy- | 0010| five dollars ($75.00). | 0011| D. Public entities may acquire a hazardous | 0012| materials transportation permit exempt from the fee in | 0013| Subsection C of this section. | 0014| E. A copy of any hazardous materials | 0015| transportation permit issued pursuant to this section shall be | 0016| carried in each vehicle included under conditions of the | 0017| permit. Hazardous materials transportation permits shall be | 0018| open for inspection by any peace officer. | 0019| F. Fees collected pursuant to this section shall | 0020| be deposited in the ~[general fund]~ |motor vehicle suspense | 0021| fund and distributed at the end of each month. The net | 0022| receipts collected pursuant to the provisions of this section | 0023| shall be distributed to the emergency response fund|." | 0024| Section 2. A new section of the Emergency Management Act | 0025| is enacted to read: | - 2 - 0001| "[|NEW MATERIAL|] EMERGENCY RESPONSE FUND CREATED.-- | 0002| A. The "emergency response fund" is created in the | 0003| state treasury. All income earned on the fund shall be | 0004| credited to the fund. | 0005| B. The department of public safety shall | 0006| administer the emergency response fund for the purpose of | 0007| equipping and training state and local first responders to | 0008| emergencies involving transportation of hazardous materials. | 0009| C. Money in the emergency response fund is | 0010| appropriated to the department of public safety for the | 0011| purpose of carrying out the provisions of Subsection B of this | 0012| section and shall not revert at the end of any fiscal year. | 0013| Disbursements from the fund shall be made by warrant drawn by | 0014| the secretary of finance and administration pursuant to | 0015| vouchers signed by the secretary of public safety or his | 0016| authorized representative. | 0017| D. No portion of the emergency response fund shall | 0018| be used for activities that are inconsistent with the federal | 0019| Hazardous Materials Transportation Act." | 0020| Section 3. EFFECTIVE DATE.--The effective date of the | 0021| provisions of this act is July 1, 1998. | 0022| - 3 - |
