0011|     RELATING TO DISTRICT ATTORNEY SALARIES; PROVIDING SALARY

0012|     INCREASES FOR DISTRICT ATTORNEYS; AUTHORIZING THE LEGISLATURE

0013|     TO ESTABLISH SALARY LEVELS ON AN ANNUAL BASIS BEGINNING IN
    |
0014|     FISCAL YEAR 2000; AMENDING A SECTION OF THE NMSA 1978; MAKING
    |
0015|     AN APPROPRIATION.

0017|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0018|          Section 1.  Section 36-1-6 NMSA 1978 (being Laws 1976
    |
0019|     (S.S.), Chapter 18, Section 1, as amended) is amended to read:
    |
0020|          "36-1-6.  DISTRICT ATTORNEYS--SALARIES.--
    |
0021|               A.  ~[Except as provided in Subsection B of this
    |
0022|     section]~ District attorneys shall receive an annual salary of
    |
0023|     ~[seventy thousand two hundred sixty-five dollars ($70,265)]~
    |
0024|     |ninety thousand dollars ($90,000)|.

0025|               ~[B.  District attorneys who serve in a district
    |

0001|     that includes a class A county within the district shall
    |
0002|     receive an annual salary of seventy-three thousand nine
    |
0003|     hundred sixty-three dollars ($73,963).]
    |
0004|               |B.  For fiscal year 2000 and all subsequent fiscal
    |
0005|     years, the annual salary for district attorneys shall be
    |
0006|     established by the legislature in an appropriation act.|"
    |
0007|          Section 2.  APPROPRIATION.--Three hundred forty-nine
    |
0008|     thousand dollars ($349,000) is appropriated from the general
    |
0009|     fund to the administrative office of the district attorneys
    |
0010|     for expenditure in fiscal year 1999 for the purpose of paying
    |
0011|     salaries and benefits for district attorneys.  Any unexpended
    |
0012|     or unencumbered balance remaining at the end of fiscal year
    |
0013|     1999 shall revert to the general fund.
    |
0014|          Section 3.  EFFECTIVE DATE.--The effective date of
    |
0015|     provisions of this act is July 1, 1998.
