0012| RELATING TO THE BACA LOCATION NUMBER 1; CREATING THE VALLES
|
0013| CALDERA PURCHASE COMMISSION TO NEGOTIATE FOR THE PURCHASE OF
|
0014| THE BACA LOCATION NUMBER 1 ON BEHALF OF THE STATE; PROVIDING
|
0015| POWERS AND DUTIES; MAKING AN APPROPRIATION.
|

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. VALLES CALDERA PURCHASE COMMISSION
|
0019| CREATED--COMPOSITION.--
|
0020| A. The "Valles Caldera purchase commission" is
|
0021| created. The commission shall be composed of ten members of
|
0022| the legislature. Five members of the house of representatives
|
0023| shall be appointed by the speaker of the house of
|
0024| representatives and five members of the senate shall be
|
0025| appointed by the committees' committee of the senate or, if
|
- 1 -0001| the senate appointments are made in the interim, by the
|
0002| president pro tempore of the senate after consultation with
|
0003| and agreement of a majority of the members of the committees'
|
0004| committee.
|
0005| B. Members shall be appointed from each house so
|
0006| as to give the two major political parties in each house the
|
0007| same proportional representation on the commission as prevails
|
0008| in each house; however, in no event shall either party have
|
0009| less than one member from each house on the commission.
|
0010| Vacancies on the commission shall be filled by appointment in
|
0011| the same manner as the original appointments. The chairman
|
0012| and vice chairman of the commission shall be elected by the
|
0013| commission.
|
0014| C. No action shall be taken by the commission if a
|
0015| majority of the total membership from either house on the
|
0016| commission rejects such action.
|
0017| Section 2. VALLES CALDERA PURCHASE COMMISSION--
|
0018| DUTIES.--The Valles Caldera purchase commission shall:
|
0019| A. negotiate, on behalf of the state, for the
|
0020| purchase of the Baca location number 1, known as the Baca
|
0021| ranch;
|
0022| B. upon the completion of successful negotiations,
|
0023| certify to the secretary of finance and administration that
|
0024| the negotiations have been successful and that the purchase
|
0025| price agreed to is no higher than the appraised value. Upon
|
- 2 -0001| receiving the certification, the secretary shall cause an
|
0002| amount equal to the purchase price to be transferred from the
|
0003| land grant permanent funds to the seller. Such amount is
|
0004| appropriated from the land grant permanent funds;
|
0005| C. solicit testimony, reports and other information
|
0006| concerning the Baca location number 1 and its potential uses and
|
0007| benefits; and
|
0008| D. submit a report of its findings and
|
0009| recommendations to the legislature, including its recommendations
|
0010| for future uses of the Baca location number 1 that will maximize
|
0011| benefits to the state and its citizens.
|
0012| Section 3. VALLES CALDERA PURCHASE COMMISSION--STAFF.--The
|
0013| staff for the Valles Caldera purchase commission shall be
|
0014| provided by the legislative council service.
|
0015| Section 4. APPROPRIATION.--For the purpose of paying the
|
0016| salaries and expenses of the technical, legal, clerical and
|
0017| stenographic assistants; for appraisals; for necessary equipment
|
0018| and supplies used in carrying out the provisions of this act; and
|
0019| for reimbursing the per diem and mileage expenses of the Valles
|
0020| Caldera purchase commission, there is appropriated to the
|
0021| legislative council service from the general fund the sum of
|
0022| forty thousand dollars ($40,000). All or any part of this
|
0023| appropriation may be expended in fiscal year 1999 and succeeding
|
0024| fiscal years. Any unexpended or unencumbered balance remaining
|
0025| at the end of the fiscal year in which the commission submits the
|
- 3 -0001| report pursuant to Subsection D of Section 2 of this act shall
|
0002| revert to the general fund. Payments from the appropriation
|
0003| shall be made upon vouchers signed by the director of the
|
0004| legislative council service or his authorized representative.
|
0005| Section 5. EFFECTIVE DATE.--The effective date of the
|
0006| provisions of this act is the later of:
|
0007| A. the date the secretary of state certifies that the
|
0008| constitution of New Mexico has been amended as proposed by a
|
0009| joint resolution of the forty-third legislature, second session,
|
0010| entitled "A JOINT RESOLUTION PROPOSING TO AMEND THE NEW MEXICO
|
0011| CONSTITUTION TO AUTHORIZE AN EXPENDITURE FROM THE LAND GRANT
|
0012| PERMANENT FUNDS FOR THE PURCHASE OF THE BACA LOCATION NUMBER 1,
|
0013| INCLUDING THE VALLES CALDERA"; or
|
0014| B. the date the congress of the United States
|
0015| consents to the amendment of the constitution of New Mexico as
|
0016| proposed by the joint resolution specified in Subsection A of
|
0017| this section.
