0011| RELATING TO EDUCATION; PROVIDING FUNDING TO CREATE A STATEWIDE

0012| TEEN PARENTING AND ABSTINENCE EDUCATION PROGRAM; CREATING A
|
0013| FUND; MAKING AN APPROPRIATION.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. [NEW MATERIAL] TEEN DEVELOPMENT FUND
|
0017| CREATED--PURPOSE.--
|
0018| A. The "teen development fund" is created in the
|
0019| state treasury and shall be administered by the state
|
0020| department of public education. Money in the fund shall be
|
0021| available for appropriation by the legislature to expand the
|
0022| existing GRADS program to a statewide program for teenagers
|
0023| that includes a wide range of education and services for teen
|
0024| parents and their children and abstinence education for early
|
0025| teens. Balances in the fund at the end of any fiscal year
|

0001| shall not revert.

0002| B. The program shall include provision of child
|
0003| care for high school students with children and programs;
|
0004| classes in basic parenting, nutrition and hygiene skills for
|
0005| high school boys and girls who are parents; and an opportunity
|
0006| for obtaining certification as a child care provider and
|
0007| participating in a concurrent enrollment program of post-
|
0008| secondary child development courses. The program may also
|
0009| develop and implement an abstinence education component for
|
0010| mid-school and junior high students in coordination with any
|
0011| program established for use of the state's block grant
|
0012| allotment of federal funds for an abstinence education program
|
0013| pursuant to 42 USCA Section 710.
|
0014| C. The state department of public education may
|
0015| contract with other state and local agencies and organizations
|
0016| as necessary to carry out the provisions of this section.
|
0017| Section 2. Section 7-1-6.38 NMSA 1978 (being Laws 1994,
|
0018| Chapter 145, Section 1, as amended) is amended to read:
|
0019| "7-1-6.38. DISTRIBUTION--GOVERNMENTAL GROSS RECEIPTS
|
0020| TAX.--
|
0021| A. A distribution pursuant to Section 7-1-6.1 NMSA
|
0022| 1978 shall be made to the public project revolving fund
|
0023| administered by the New Mexico finance authority in an amount
|
0024| equal to seventy-five percent of the net receipts attributable
|
0025| to the governmental gross receipts tax.

0001| B. A distribution pursuant to Section 7-1-6.1 NMSA
|
0002| 1978 shall be made [to the energy, minerals and natural
|
0003| resources department] in an amount equal to twenty-five
|
0004| percent of the net receipts attributable to the governmental
|
0005| gross receipts tax in the following amounts as follows.
|
0006| Forty percent of the distribution is appropriated to the
|
0007| [energy, minerals and natural resources department to
|
0008| implement the provisions of the New Mexico Youth Conservation
|
0009| Corps Act] teen development fund and sixty percent of the
|
0010| distribution is appropriated to the energy, minerals and
|
0011| natural resources department for state park and recreation
|
0012| area capital improvements, including the costs of planning,
|
0013| engineering, design, construction, renovation, repair,
|
0014| equipment and furnishings.
|
0015| C. The state pledges to and agrees with the
|
0016| holders of any bonds or notes issued by the New Mexico finance
|
0017| authority or by the energy, minerals and natural resources
|
0018| department and payable from the net receipts attributable to
|
0019| the governmental gross receipts tax distributed to the New
|
0020| Mexico finance authority or the energy, minerals and natural
|
0021| resources department pursuant to this section that the state
|
0022| will not limit, reduce or alter the distribution of the net
|
0023| receipts attributable to the governmental gross receipts tax
|
0024| to the New Mexico finance authority or the energy, minerals
|
0025| and natural resources department or limit, reduce or alter the
|

0001| rate of imposition of the governmental gross receipts tax
|
0002| until the bonds or notes together with the interest thereon
|
0003| are fully met and discharged. The New Mexico finance
|
0004| authority and the energy, minerals and natural resources
|
0005| department are authorized to include this pledge and agreement
|
0006| of the state in any agreement with the holders of the bonds or
|
0007| notes."
|
0008| Section 3. EFFECTIVE DATE.--The effective date of the
|
0009| provisions of this act is July 1, 1998.
