0011| CREATING THE NATIVE AMERICAN HEALTH CARE OVERSIGHT COMMISSION;
|
0012| MAKING AN APPROPRIATION; DECLARING AN EMERGENCY.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. NATIVE AMERICAN HEALTH CARE OVERSIGHT
|
0016| COMMISSION CREATED--TERMINATION.--The "Native American health
|
0017| care oversight commission" is created. The commission shall
|
0018| function from the date of its appointment until December 1
|
0019| prior to the first session of the forty-fourth legislature.
|
0020| Section 2. MEMBERSHIP--APPOINTMENT--VACANCIES.--
|
0021| A. The Native American health care oversight
|
0022| commission shall be composed of eleven voting members,
|
0023| appointed in the following manner:
|
0024| (1) two members of the Navajo Nation, who
|
0025| shall be appointed by the tribal president;
|

0001| (2) two members of a pueblo tribe, who shall
|
0002| be appointed by the all-Indian pueblo council;
|
0003| (3) two members of an Apache tribe, who shall
|
0004| be appointed by the tribal president;
|
0005| (4) the director of the Indian health service
|
0006| or his designee; and
|
0007| (5) four nontribal members appointed by the
|
0008| governor.
|
0009| B. Vacancies on the commission shall be filled by
|
0010| appointment in the same manner as the original appointments.
|
0011| C. Members shall be paid per diem and mileage in
|
0012| accordance with the provisions of the Per Diem and Mileage
|
0013| Act.
|
0014| Section 3. DUTIES.--After the Native American health
|
0015| care oversight commission members are appointed, the
|
0016| commission shall hold one organizational meeting to develop a
|
0017| work plan for the ensuing year. The commission shall review
|
0018| issues related to the delivery of health care to Native
|
0019| American populations in the state, including evaluating the
|
0020| sufficiency of health care services, especially in rural
|
0021| areas, and reviewing costs and the quality and availability of
|
0022| services, and shall recommend legislation or changes, if any
|
0023| are found to be necessary, to the first session of the forty-
|
0024| fourth legislature.

0025| Section 4. REPORT.--The Native American health care
|

0001| oversight commission shall make a report of its findings and
|
0002| recommendations for the consideration of the first session of
|
0003| the forty-fourth legislature. The reports and suggested
|
0004| legislation shall be made available to the New Mexico
|
0005| legislative council, the legislative health and human services
|
0006| committee and the interim Indian affairs committee no later
|
0007| than November 1, 1998.
|
0008| Section 5. STAFF.--The staff for the Native American
|
0009| health care oversight commission shall be provided by the New
|
0010| Mexico office of Indian affairs.
|
0011| Section 6. APPROPRIATION.--For the purpose of paying
|
0012| contract assistants, necessary equipment and supplies used in
|
0013| carrying out the provisions of this act, for travel expenses
|
0014| for staff and commission members and for reimbursing the per
|
0015| diem and mileage expenses of the Native American health care
|
0016| oversight commission, one hundred thousand dollars ($100,000)
|
0017| is appropriated to the New Mexico office of Indian affairs
|
0018| from the general fund for expenditure in fiscal year 1999.
|
0019| Any unexpended or unencumbered balance remaining at the end of
|
0020| fiscal year 1999 shall revert to the general fund.
|
0021| Section 7. EMERGENCY.--It is necessary for the public
|
0022| peace, health and safety that this act take effect
|
0023| immediately.
|

|
