0011| CREATING A JOINT INTERIM LEGISLATIVE FEDERAL FUNDS TASK FORCE;
|
0012| MAKING AN APPROPRIATION; DECLARING AN EMERGENCY.
|

|
0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. FEDERAL FUNDS TASK FORCE CREATED--
|
0016| TERMINATION.--There is created a joint interim legislative
|
0017| task force, which shall be known as the "federal funds task
|
0018| force". The task force shall function from the date of its
|
0019| appointment until of December 1 prior to the first session of
|
0020| the forty-fourth legislature.
|
0021| Section 2. MEMBERSHIP--APPOINTMENT--VACANCIES.--
|
0022| A. The task force shall be composed of six
|
0023| legislative members and four nonlegislative members. Three
|
0024| members of the house of representatives, one of whom shall be
|
0025| a member of the legislative finance committee, shall be

0001| appointed by the speaker of the house of representatives, and
|
0002| three members of the senate, one of whom shall be a member of
|
0003| the legislative finance committee, shall be appointed by the
|
0004| committees' committee of the senate, or, if the senate
|
0005| appointments are made in the interim, by the president pro
|
0006| tempore of the senate after consultation with and agreement of
|
0007| a majority of the members of the committees' committee.
|
0008| B. Members shall be appointed from each house so
|
0009| as to give the two major political parties in each house the
|
0010| same proportional representation on the task force as prevails
|
0011| in each house; however, in no event shall either party have
|
0012| less than one member from each house on the task force.
|
0013| Vacancies on the task force shall be filled by appointment in
|
0014| the same manner as the original appointments. The speaker of
|
0015| the house of representatives and the president pro tempore of
|
0016| the senate shall each appoint a co-chairman.
|
0017| C. No action shall be taken by the task force if a
|
0018| majority of the total membership from either house on the task
|
0019| force rejects such action.
|
0020| D. Two nonlegislative members of the task force
|
0021| who do not serve ex officio shall be appointed by the speaker
|
0022| of the house of representatives and the president pro tempore
|
0023| of the senate and shall represent advocates for recipients of
|
0024| federal funds.
|
0025| E. Two additional nonlegislative members shall be:

0001| (1) the secretary of finance and
|
0002| administration or his designee; and
|
0003| (2) the secretary of human services or his
|
0004| designee.
|
0005| F. The public members shall be paid per diem and
|
0006| mileage in accordance with the provisions of the Per Diem and
|
0007| Mileage Act.
|
0008| Section 3. DUTIES.--After its appointment, the task
|
0009| force shall hold one organizational meeting to develop a work
|
0010| plan and budget for the ensuing interim. The work plan and
|
0011| budget shall be submitted to the New Mexico legislative
|
0012| council for approval. Upon approval of the work plan and
|
0013| budget by the New Mexico legislative council, the task force
|
0014| shall:
|
0015| A. identify the major sources of federal funds
|
0016| received by the state; the federal requirements for receiving
|
0017| and expending each major source of funds; the programs
|
0018| developed by the state for the expenditure of the federal
|
0019| funds; and the state and federal authority for the development
|
0020| and implementation of the programs; and
|
0021| B. determine if New Mexico's current process for
|
0022| receiving and expending federal funds can be improved to avoid
|
0023| duplication of effort, to strengthen state control over
|
0024| programs implemented in New Mexico and to ensure that New
|
0025| Mexico is obtaining the maximum benefit from the utilization
|

0001| of state and federal money.

0002| Section 4. SUBCOMMITTEES.--Subcommittees shall be
|
0003| created only by majority vote of all members appointed to the
|
0004| task force and with the prior approval of the New Mexico
|
0005| legislative council. A subcommittee shall be composed of at
|
0006| least one member from the senate and one member from the house
|
0007| of representatives, and at least one member of the minority
|
0008| party shall be a member of the subcommittee. All meetings and
|
0009| expenditures of a subcommittee shall be approved by the full
|
0010| task force in advance of such meeting or expenditure, and the
|
0011| approval shall be shown in the minutes of the task force.
|
0012| Section 5. REPORT.--The task force shall make a report
|
0013| of its findings and recommendations for the consideration of
|
0014| the first session of the forty-fourth legislature. The report
|
0015| and suggested legislation shall be made available to the New
|
0016| Mexico legislative council and the legislative finance
|
0017| committee on or before December 15 preceding that session.
|
0018| Section 6. STAFF.--The staff for the task force shall be
|
0019| provided by the legislative council service.
|
0020| Section 7. APPROPRIATION.--Fifty thousand dollars
|
0021| ($50,000) is appropriated from the general fund to the
|
0022| legislative council service for expenditure in fiscal years
|
0023| 1998 and 1999 for the purpose of paying the salaries and
|
0024| expenses of the technical, legal, clerical and stenographic
|
0025| assistants, for necessary equipment and supplies used in
|

0001| carrying out the provisions of this act and for reimbursing
|
0002| the per diem and mileage expenses of the task force. Any
|
0003| unexpended or unencumbered balance remaining at the end of
|
0004| fiscal year 1999 shall revert to the general fund. Payments
|
0005| from the appropriation shall be made upon vouchers signed by
|
0006| the director of the legislative council service or the
|
0007| director's authorized representative.
|
0008| Section 8. EMERGENCY.--It is necessary for the public
|
0009| peace, health and safety that this act take effect
|
0010| immediately.
