0011|     RELATING TO TOBACCO PRODUCTS; PROVIDING CRIMINAL PENALTIES FOR

0012|     A BUSINESS THAT EMPLOYEES A PERSON WHO VIOLATES THE PROVISIONS

0013|     OF THE TOBACCO PRODUCTS ACT; AMENDING SECTIONS OF THE TOBACCO
    |
0014|     PRODUCTS ACT.

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|          Section 1.  Section 30-49-3 NMSA 1978 (being Laws 1993,
    |
0018|     Chapter 244, Section 3) is amended to read:
    |
0019|          "30-49-3.  TOBACCO--PROHIBITED SALES.--
    |
0020|               A.  <s>[No]</s> <u>A</u> person <u>or business</u> shall
    |
0021|     <u></u><s>[knowingly]</s> <u>not</u> sell, offer to sell, barter or give any
    |
0022|     tobacco product to any minor.
    |
0023|               B.  <s>[No]</s> <u>A</u> minor shall <u>not</u> procure or attempt
    |
0024|     to procure any tobacco products for his own use or for use by
    |
0025|     any other minor.
    |

0001|               C.  <s>[No]</s> <u>A</u> person <u>or business</u> shall <u>not</u>
    |
0002|     sell, offer to sell or deliver a tobacco product in a form
    |
0003|     other than an original factory-sealed package."

0004|          Section 2.  Section 30-49-12 NMSA 1978 (being Laws 1993,
    |
0005|     Chapter 244, Section 12) is amended to read:
    |
0006|          "30-49-12.  PENALTY.--
    |
0007|               A.  <s>[Any]</s> <u>A</u> person who violates any provision
    |
0008|     of Subsection A of Section <s>[3 or Sections 5, 7, 8 or 9 of the
</s>    |
<s></s>0009| <s>    Tobacco Products Act]</s> <u>30-49-3 NMSA 1978 or Section 30-49-5,
</u>    |
<u></u>0010| <u>    30-49-7, 30-49-8 or 30-49-9 NMSA 1978</u> is guilty of a
    |
0011|     misdemeanor and shall be sentenced pursuant to the provisions
    |
0012|     of Section 31-19-1 NMSA 1978.  Each violation is a separate
    |
0013|     and distinct offense.
    |
0014|               B.  <s>[Any]</s> <u>A</u> minor who violates any provision of
    |
0015|     Subsection B of Section <s>[3 or Section 6 of the Tobacco
</s>    |
<s></s>0016| <s>    Products Act]</s> <u>30-49-3 NMSA 1978 or Section 30-49-6 NMSA
</u>    |
<u></u>0017| <u>    1978</u> shall be punished by a fine not to exceed one hundred
    |
0018|     dollars ($100) or forty-eight hours of community service.
    |
0019|               <u>C.  A business that employs a person who violates
</u>    |
<u></u>0020| <u>    any provisions of Subsection A of Section 30-49-3 NMSA 1978 or
</u>    |
<u></u>0021| <u>    Section 30-49-5, 30-49-7, 30-49-8 or 30-49-9 NMSA 1978 is
</u>    |
<u></u>0022| <u>    guilty of a misdemeanor and shall be sentenced pursuant to the
</u>    |
<u></u>0023| <u>    provisions of Section 31-19-1 NMSA 1978.  Each violation is a
</u>    |
<u></u>0024| <u>    separate and distinct offense.</u>"

0025|          Section 3.  EFFECTIVE DATE.--The effective date of the
    |
