0011| RELATING TO DRIVER'S LICENSES AND IDENTIFICATION CARDS;
|
0012| AMENDING CERTAIN SECTIONS OF THE NMSA 1978.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 66-5-20 NMSA 1978 (being Laws 1978,
|
0016| Chapter 35, Section 242) is amended to read:
|
0017| "66-5-20. [DUPLICATE] REPLACEMENT LICENSES.--In the
|
0018| event that a permit or driver's license issued under the
|
0019| provisions of this article is lost, stolen, mutilated or
|
0020| destroyed, or in the event of a name [and] or address
|
0021| change, the person to whom the [same] permit or driver's
|
0022| license was issued may, upon payment of the required fee,
|
0023| obtain a [duplicate or substitute thereof] replacement
|
0024| upon furnishing proof of age and identity satisfactory to
|
0025| the [division] department. Any person who loses a permit
|

0001| or driver's license and who, after obtaining a replacement,
|
0002| finds the original permit or driver's license, shall
|
0003| immediately surrender the original permit or driver's license
|
0004| to the department."
|
0005| Section 2. Section 66-5-47 NMSA 1978 (being Laws 1978,
|
0006| Chapter 35, Section 269, as amended) is amended to read:
|
0007| "66-5-47. PHOTOGRAPHS--EVIDENCE OF APPLICANT'S AGE.--
|
0008| A. The [division] department shall reproduce
|
0009| the likeness of drivers, subject to the following conditions:
|
0010| (1) photographs or other reproductions of the
|
0011| likeness of all persons shall show a full face or front view;
|
0012| and
|
0013| (2) photographs or other reproductions of the
|
0014| likeness of all persons under the age of twenty-one years
|
0015| shall have a printed legend, indicating that the person is
|
0016| under twenty-one, which shall be displayed in such manner as
|
0017| to be easily read by any person inspecting the license.
|
0018| B. Each applicant for an initial license or a
|
0019| replacement license shall produce evidence of the applicant's
|
0020| age. Proof of an applicant's age shall be a birth
|
0021| certificate, copy of a birth certificate, [a church record
|
0022| purporting to show the date of birth and baptism, an
|
0023| acknowledged copy of the church record] a valid passport or
|
0024| other evidence which the [director] secretary deems
|
0025| sufficient. The date of birth shown on any driver's license
|

0001| or any instruction permit issued by the [division]
|
0002| department shall coincide with the date of birth shown on
|
0003| the proof of the applicant's age."
|
0004| Section 3. Section 66-5-401 NMSA 1978 (being Laws 1978,
|
0005| Chapter 35, Section 328, as amended) is amended to read:
|
0006| "66-5-401. IDENTIFICATION CARDS.--Any person [thirteen
|
0007| years of age or older] who does not have a valid New Mexico
|
0008| driver's license may be issued an identification card by the
|
0009| [division] department certified by the [registrant and
|
0010| attested to by the division] applicant as to true name,
|
0011| correct age and other identifying data as the [division]
|
0012| department may require. Every application for an
|
0013| identification card shall be signed by the applicant or, in
|
0014| the case of a minor, by the applicant's parent or guardian.
|
0015| The [director] secretary may, for good cause [shown],
|
0016| revoke or deny the issuance of an identification card."
|
0017| Section 4. Section 66-5-402 NMSA 1978 (being Laws 1978,
|
0018| Chapter 35, Section 329, as amended) is amended to read:
|
0019| "66-5-402. PERSONS ELIGIBLE FOR IDENTIFICATION CARDS.--
|
0020| The department shall issue an identification card only to:
|
0021| A. a person who is a New Mexico resident and who
|
0022| does not have a valid New Mexico driver's license and only
|
0023| upon the furnishing of a birth certificate, [a certificate of
|
0024| baptism] a copy of a birth certificate, a valid passport or
|
0025| other evidence that the department deems sufficient as
|

0001| documentary evidence of the age and identity of the person; or
|
0002| B. a person over age sixty-five who is a New
|
0003| Mexico resident and who is surrendering a valid New Mexico
|
0004| driver's license, which license shall be sufficient
|
0005| documentary evidence of the age and identity of the person."
|
0006| Section 5. Section 66-5-404 NMSA 1978 (being Laws 1978,
|
0007| Chapter 35, Section 331) is amended to read:
|
0008| "66-5-404. DUPLICATE CARDS.--In the event an
|
0009| identification card issued pursuant to the provisions of
|
0010| Section 66-5-402 NMSA 1978 is lost, stolen, destroyed or
|
0011| mutilated or [a new name is acquired] in the event of a
|
0012| name or address change, the person to whom [it] the
|
0013| identification card was issued [shall] may, upon payment
|
0014| of the required fee, obtain a [duplicate] replacement
|
0015| upon furnishing satisfactory proof of [such fact] age and
|
0016| identity to the [division and paying the required fee]
|
0017| department. Any person who loses an identification card and
|
0018| who, after obtaining a [duplicate] replacement, finds the
|
0019| original card shall immediately surrender the original card to
|
0020| the [division] department. The same documentary evidence
|
0021| shall be furnished for a [duplicate] replacement as for an
|
0022| original identification card."
|
0023| Section 6. EFFECTIVE DATE.--The effective date of the
|
0024| provisions of this act is July 1, 1998.
