0011| RELATING TO GAME AND FISH; CREATING A TEMPORARY SMALL GAME

0012| LICENSE; IMPOSING A FEE; AMENDING SECTIONS OF THE NMSA 1978.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 17-3-2 NMSA 1978 (being Laws 1964
|
0016| (1st S.S.), Chapter 17, Section 2, as amended) is amended to
|
0017| read:
|
0018| "17-3-2. CLASSES OF LICENSES.--
|
0019| A. As used with reference to licenses in Chapter
|
0020| 17 NMSA 1978:
|
0021| (1) "fishing" entitles the licensee to fish
|
0022| for game fish during the open seasons for each species;
|
0023| (2) "small game" entitles the licensee to
|
0024| hunt game birds, other than wild turkey, and squirrel during
|
0025| the open seasons for each;

0001| (3) "deer" entitles the licensee to hunt deer
|
0002| during the open season;
|
0003| (4) "general hunting" entitles the licensee
|
0004| to hunt deer, squirrel and game birds during the open seasons
|
0005| for each;
|
0006| (5) "general hunting and fishing" entitles
|
0007| the licensee to hunt deer, squirrel and game birds and to fish
|
0008| for game fish during the open seasons for each;
|
0009| (6) "antelope" entitles the licensee to hunt
|
0010| antelope during the open season;
|
0011| (7) "elk" entitles the licensee to hunt elk
|
0012| during the open season;
|
0013| (8) "bighorn sheep" entitles the licensee to
|
0014| hunt bighorn sheep during the open season;
|
0015| (9) "Barbary sheep" entitles the licensee to
|
0016| hunt Barbary sheep during the open season;
|
0017| (10) "javelina" entitles the licensee to hunt
|
0018| javelina during the open season;
|
0019| (11) "bear" entitles the licensee to hunt
|
0020| bear during the open season;
|
0021| (12) "nongame" entitles the licensee to hunt
|
0022| or take any animal or bird not protected by law;
|
0023| (13) "temporary fishing" entitles the
|
0024| licensee to fish for game fish during a specific period of
|
0025| time indicated on the license;

0001| (14) "bison" entitles the licensee to hunt
|
0002| bison during the open season;
|
0003| (15) "oryx" entitles the licensee to hunt
|
0004| oryx during the open season;
|
0005| (16) "ibex" entitles the licensee to hunt
|
0006| ibex during the open season;
|
0007| (17) "cougar" entitles the licensee to hunt
|
0008| cougar during the open season;
|
0009| (18) "turkey" entitles the licensee to hunt
|
0010| turkey during the open season;
|
0011| (19) "special season turkey" entitles the
|
0012| licensee to hunt turkey during special seasons designated by
|
0013| the state game commission;
|
0014| (20) "quality elk" entitles the licensee to
|
0015| hunt elk during a special quality elk season, to be
|
0016| established by the state game commission, when the timing of
|
0017| the season and hunter density is specially regulated and the
|
0018| elk population is managed with an intent to provide the
|
0019| licensee an increased opportunity to take a mature elk;
|
0020| (21) "quality deer" entitles the licensee to
|
0021| hunt deer during a special quality deer season, to be
|
0022| established by the state game commission, when the timing of
|
0023| the season and hunter density is specially regulated and the
|
0024| deer population is managed with an intent to provide the
|
0025| licensee an increased opportunity to take a mature deer;

0002| (22) "gazelle" entitles the licensee to hunt
|
0003| gazelle during the open season; and
|
0004| (23) "temporary small game" entitles the
|
0005| licensee to hunt game birds, except wild turkey, and squirrel
|
0006| during a specific period of time indicated on the license.
|
0007| B. No hunting license entitles the licensee to
|
0008| hunt, kill or take game animals or birds within or upon any
|
0009| park or enclosure licensed or posted as provided by law or
|
0010| within or upon any privately owned enclosure without consent
|
0011| of the owner or within or upon any game refuge or game
|
0012| management area.
|
0013| C. No fishing license entitles the licensee to
|
0014| fish for or take fish within or upon any park or enclosure
|
0015| licensed or posted as provided by law or within or upon any
|
0016| privately owned enclosure without consent of the owner or in
|
0017| or on any closed waters.
|
0018| D. A junior-senior fishing license may be
|
0019| purchased by any resident who has reached his twelfth birthday
|
0020| but has not reached his fifteenth birthday or by any resident
|
0021| who has reached his sixty-fifth birthday. A junior-senior
|
0022| fishing license entitles the licensee to fish for game fish
|
0023| during the open season for each species.
|
0024| E. A nonresident junior fishing license may be
|
0025| purchased by any nonresident who has reached his twelfth
|

0001| birthday but has not reached his fifteenth birthday. A
|
0002| nonresident junior fishing license entitles the licensee to
|
0003| fish for game fish during the open season for each species.
|
0004| [F. None of the classes of trout stamps provided
|
0005| for in Subsection A of this section is required of any person
|
0006| fishing on lands of any Indian pueblo or tribe.
|
0007| G.] F. A senior general hunting license may be
|
0008| purchased by any resident who has reached his sixty-fifth
|
0009| birthday. A senior general hunting license entitles the
|
0010| licensee to hunt for deer, squirrel and game birds during the
|
0011| open seasons for each species.
|
0012| [H.] G. A handicapped fishing license may be
|
0013| purchased by any resident who has a severe physical impairment
|
0014| that substantially limits one or more major life activities
|
0015| and who can furnish adequate proof of this disability to the
|
0016| state game commission. A handicapped fishing license may be
|
0017| purchased by any resident who has a developmental disability
|
0018| as defined in Subsection H of Section 43-1-3 NMSA 1978 and who
|
0019| can furnish adequate proof of this disability to the state
|
0020| game commission. A handicapped fishing license entitles the
|
0021| licensee to fish for game fish during the open season for each
|
0022| species [provided, however, the class C trout stamp would
|
0023| apply].
|
0024| [I.] H. A handicapped general hunting license
|
0025| may be purchased by any resident who has a severe physical
|

0001| impairment that substantially limits one or more major life
|
0002| activities and who can furnish adequate proof of this
|
0003| disability to the state game commission. A handicapped
|
0004| general hunting license entitles the licensee to hunt for
|
0005| deer, squirrel and game birds during the open season for each
|
0006| species.
|
0007| [J.] I. A fishing license may be obtained at
|
0008| no cost by any resident who has reached his seventieth
|
0009| birthday."
|
0010| Section 2. Section 17-3-13 NMSA 1978 (being Laws 1964
|
0011| (1st S.S.), Chapter 17, Section 5, as amended) is amended to
|
0012| read:
|
0013| "17-3-13. LICENSE FEES.--
|
0014| A. The director of the department of game and fish
|
0015| shall keep a record of all money received and licenses and
|
0016| permits issued by him, numbering each class separately. Upon
|
0017| satisfactory proof that any license or permit has been lost
|
0018| before its expiration, he may issue a duplicate and collect a
|
0019| just and reasonable fee for it as determined by regulation of
|
0020| the state game commission.
|
0021| B. The director of the department of game and fish
|
0022| shall collect the following fees for each license of the class
|
0023| indicated:
|
