0011|     RELATING TO THE ENVIRONMENT; PROVIDING FOR THE RECOVERY OF

0012|     COSTS BY A POLITICAL SUBDIVISION FOR RESPONDING TO A HAZARDOUS

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0016|          Section 1.  RIGHT TO CLAIM REIMBURSEMENT.--
    |
0017|               A.  A political subdivision of the state may claim
    |
0018|     reimbursement from a person responsible for a hazardous
    |
0019|     material emergency for the costs resulting from action taken
    |
0020|     to remove, contain or otherwise mitigate the effects of the
    |
0021|     emergency, including reasonable attorney fees and costs in
    |
0022|     collecting the reimbursement. 
    |
0023|               B.  Nothing contained in this section shall be
    |
0024|     construed to impair any right of recovery arising under any
    |
0025|     other provision of law.

0001|               C.  Any collections or recovery made by a political

0002|     subdivision shall be distributed among the agencies that
    |
0003|     rendered assistance in proportion to their costs.
