0011|     RELATING TO PROCUREMENT; AMENDING A SECTION OF THE PROCUREMENT

0012|     CODE TO PROVIDE FOR CERTAIN MULTI-TERM CONTRACTS.

0014|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0015|          Section 1.  Section 13-1-150 NMSA 1978 (being Laws 1984,
    |
0016|     Chapter 65, Section 123, as amended by Laws 1993, Chapter 225,
    |
0017|     Section 1 and also by Laws 1993, Chapter 231, Section 13) is
    |
0018|     amended to read:
    |
0019|          "13-1-150.  MULTI-TERM CONTRACTS--SPECIFIED PERIOD.--A 
    |
0020|     multi-term contract for items of tangible personal property,
    |
0021|     construction or services except for professional services, in
    |
0022|     an amount under twenty-five thousand dollars ($25,000), may be
    |
0023|     entered into for any period of time deemed to be in the best
    |
0024|     interests of the state agency or a local public body not to
    |
0025|     exceed four years; provided that the term of the contract and
    |

0001|     conditions of renewal or extension, if any, are included in
    |
0002|     the specifications and funds are available for the first
    |
0003|     fiscal period at the time of contracting.  If the amount of
    |
0004|     the contract is twenty-five thousand dollars ($25,000) or
    |
0005|     more, the term shall not exceed eight years, including all
    |
0006|     extensions and renewals, except that for any such contract
    |
0007|     entered into pursuant to the Public Building Energy Efficiency
    |
0008|     <u>and Water Conservation</u> Act, the term shall not exceed ten
    |
0009|     years, including all extensions and renewals.  Payment and
    |
0010|     performance obligations for succeeding fiscal periods shall be
    |
0011|     subject to the availability and appropriation of funds
    |
0012|     <s>[therefore]</s> <u>therefor</u>.  A contract for professional
    |
0013|     services, except for services required to support or operate
    |
0014|     federally certified medicaid, financial assistance and child
    |
0015|     support enforcement management information or payment systems
    |
0016|     <u>and except for services to design, develop or implement

<u></u>0017| <u>    taxation and revenue information management systems</u> may not
    |
0018|     exceed a term of four years, including all extensions and
    |
0019|     renewals, except that a multi-term contract for the services
    |
0020|     of trustees, escrow agents, registrars, paying agents, letter
    |
0021|     of credit issuers and other forms of credit enhancement and
    |
0022|     other similar services, excluding bond attorneys, underwriters
    |
0023|     and financial advisors with regard to the issuance, sale and
    |
0024|     delivery of public securities, may be for the life of the
    |
0025|     securities or as long as the securities remain outstanding."
