0013| THE PUBLIC WORKS CONTRACTS OR PROJECTS SUBJECT TO CERTAIN WAGE

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 13-4-11 NMSA 1978 (being Laws 1965,
|
0018| Chapter 35, Section 1, as amended) is amended to read:
|
0019| "13-4-11. MINIMUM WAGES ON PUBLIC WORKS--WEEKLY
|
0020| PAYMENT--POSTING WAGE SCALE--WITHHOLDING FUNDS.--Every
|
0021| contract or project in excess of [twenty thousand dollars
|
0022| ($20,000)] two hundred thousand dollars ($200,000) to which
|
0023| the state or any political subdivision thereof is a party for
|
0024| construction, alteration, demolition or repair or any
|
0025| combination of these, including painting and decorating, of
|

0001| public buildings, public works or public roads of the state
|
0002| and which requires or involves the employment of mechanics,
|
0003| laborers or both shall contain a provision stating the minimum
|
0004| wages to be paid to various classes of laborers and mechanics,
|
0005| which shall be based upon the wages that will be determined by
|
0006| the director of the labor and industrial division of the labor
|
0007| department to be prevailing for the corresponding classes of
|
0008| laborers and mechanics employed on contract work of a similar
|
0009| nature in the state or locality, and every contract or project
|
0010| shall contain a stipulation that the contractor,
|
0011| subcontractor, employer or any person acting as a contractor
|
0012| shall pay all mechanics and laborers employed on the site of
|
0013| the project, unconditionally and not less often than once a
|
0014| week and without subsequent unlawful deduction or rebate on
|
0015| any account, the full amounts accrued at time of payment
|
0016| computed at wage rates not less than those stated in the
|
0017| minimum wage rates issued for the project.
|
0018| A. For the purposes of making wage determinations,
|
0019| the director of the labor and industrial division of the labor
|
0020| department shall conduct a continuing program for the
|
0021| obtaining and compiling of wage-rate information and shall
|
0022| encourage the voluntary submission of wage-rate data by
|
0023| contractors, contractors' associations, labor organizations,
|
0024| interested persons and public officers. Before making a
|
0025| determination of wage rates for any project, [he] the
|

0001| director shall give due regard to the information thus
|
0002| obtained. Whenever the director deems that the data at hand
|
0003| are insufficient to make a wage determination, he may have a
|
0004| field survey conducted for the purpose of obtaining sufficient
|
0005| information upon which to make determination of wage rates.
|
0006| Any interested person shall have the right to submit to the
|
0007| director written data, views and arguments why the wage
|
0008| determination should be changed.
|
0009| B. The scale of wages to be paid shall be posted
|
0010| by the contractor or person acting as a contractor in a
|
0011| prominent and easily accessible place at the site of the work.
|
0012| [and it is further provided that] There may be withheld from
|
0013| the contractor, subcontractor, employer or any person acting
|
0014| as a contractor so much of accrued payments as may be
|
0015| considered necessary by the contracting officer to pay to
|
0016| laborers and mechanics employed on the project the difference
|
0017| between the rates of wages required by the director of the
|
0018| labor and industrial division of the labor department to be
|
0019| paid to laborers and mechanics on the work and the rates of
|
0020| wages received by such laborers and mechanics and not refunded
|
0021| to the contractor, subcontractor, employer or any person
|
0022| acting as a contractor or their agents.

0023| C. The director of the labor and industrial
|
0024| division of the labor department [shall have authority to]
|
0025| may issue rules and regulations necessary to administer and
|
