0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|          Section 1.  Section 6-6-12 NMSA 1978 (being Laws 1968,
    |
0018|     Chapter 72, Section 8, as amended) is amended to read:
    |
0019|          "6-6-12.  EXEMPTIONS FROM BATEMAN ACT.--Insurance
    |
0020|     contracts not exceeding five years, <u>joint projects between
</u>    |
<u></u>0021| <u>    two or more governmental entities that have a positive impact
</u>    |
<u></u>0022| <u>    on the health, safety and welfare of a region</u>, lease-purchase
    |
0023|     agreements, lease agreements, contracts providing for the
    |
0024|     operation or provision and operation of a jail <u>by another
</u>    |
<u></u>0025| <u>    governmental entity or</u> by an independent contractor entered
    |

0001|     into by a local public body set out in Section 6-6-11 NMSA

0002|     1978 and guaranteed energy savings contracts and installment
    |
0003|     payment contracts or lease-purchase agreements pursuant to
    |
0004|     guaranteed energy savings contracts are exempt from the
    |
0005|     provisions of Section 6-6-11 NMSA 1978, and such contracts,
    |
0006|     lease-purchase agreements, lease agreements and jail contracts
    |
0007|     are declared not to constitute the creation of debt."
