0014| FOR THE REPORTING OF TEST OR ASSESSMENT RESULTS TO THE STATE
|
0015| DEPARTMENT OF PUBLIC EDUCATION.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 22-1-6 NMSA 1978 (being Laws 1989,
|
0019| Chapter 308, Section 1, as amended by Laws 1997, Chapter 261,
|
0020| Section 1) is amended to read:
|
0021| "22-1-6. ANNUAL SCHOOL DISTRICT ACCOUNTABILITY REPORT
|
0022| REQUIRED.--
|
0023| A. School districts shall be required to publish
|
0024| an annual school district accountability report to provide
|
0025| district-wide data for the previous school year. The state
|

0001| board shall establish the format for the accountability
|
0002| reports and ensure that the relevant data is provided annually
|
0003| to parents, students, educators, policymakers, legislators,
|
0004| the governor and business and economic development
|
0005| organizations. The department of education shall establish
|
0006| the following five indices through which public school
|
0007| performance shall be measured and reported to school
|
0008| districts:
|
0009| (1) student achievement as measured by a
|
0010| nationally norm-referenced test approved by the department of
|
0011| education or through a performance-based instrument to measure
|
0012| proficiency;
|
0013| (2) school safety;
|
0014| (3) the drop-out rate;
|
0015| (4) attendance; and
|
0016| (5) parent and community involvement.
|
0017| The department of education shall establish the
|
0018| methodology for measuring each of the five indices.
|
0019| B. Effective July 1, 1998, school districts shall
|
0020| annually administer a nationally norm-referenced test or a
|
0021| standards-based assessment to a student enrolled in a public
|
0022| school in grades one, three, five and seven unless the student
|
0023| is incapable of taking the test due to a profound disability.
|
0024| School districts shall report the following to the department
|
0025| of education:

0001| (1) the results of the norm-referenced test
|
0002| or standards-based assessment;
|
0003| (2) the number of enrolled students who did
|
0004| not take the test, the school in which they are enrolled and
|
0005| the reason for the exemption from the test; and
|
0006| (3) as part of the aggregate report and
|
0007| separately, the results of assessments of students enrolled in
|
0008| special education class A, B, C and D programs who took the
|
0009| test and the school in which they are enrolled.
|
0010| C. Effective July 1, 1999, school districts shall
|
0011| annually administer a nationally norm-referenced test or a
|
0012| standards-based assessment to a student enrolled in a public
|
0013| school in grades one through eight unless the student is
|
0014| incapable of taking the test due to a profound disability.
|
0015| School districts shall report the following to the department
|
0016| of education:
|
0017| (1) the results of the norm-referenced
|

|
0019| (2) the number of enrolled students who
|
0020| did not take the test, the school in which they are enrolled
|
0021| and the reason for the exemption from the test; and
|
0022| (3) as part of the aggregate report and

|

|
0025| test and the school in which they are enrolled.

0001| [B.] D. School districts shall set two-, four-
|
0002| and six-year benchmarks in each of the five indices for each
|
0003| public school. Local school boards may establish additional
|
0004| indices, if reviewed by the department of education, through
|
0005| which to measure the school district's performance in other
|
0006| areas.
|
0007| [C.] E. The annual accountability report shall
|
0008| also include the results of a survey of parents' views of the
|
0009| quality of their children's school. The survey shall be
|
0010| conducted each year in time to include the results in the
|
0011| annual accountability report. The survey shall compile the
|
0012| results of a written questionnaire that shall be sent home
|
0013| with the students to be given to their parents. The survey
|
0014| may be completed anonymously. The survey shall be no more
|
0015| than one page, shall be clearly and concisely written and
|
0016| shall include not more than twenty questions that shall be
|
0017| answered with options of a simple sliding scale ranging from
|
0018| "strongly agree" to "strongly disagree" and shall include the
|
0019| optional response "don't know". The survey shall also include
|
0020| a request for optional written comments, which may be written
|
0021| on the back of the questionnaire form. The questionnaire
|
0022| shall include questions in the following areas:
|
0023| (1) parent-teacher-school relationship and
|
0024| communication;
|
0025| (2) quality of educational and
|

0001| extracurricular programs;
|
0002| (3) instructional practices and techniques;
|
0003| (4) resources;
|
0004| (5) school personnel, including the school
|
0005| principal; and
|
0006| (6) parents' view of teaching staff
|
0007| expectations for the students.
|
0008| The state board shall develop no more than ten of the
|
0009| questions which shall be reviewed by the legislative education
|
0010| study committee prior to implementation. No more than five
|
0011| questions shall be developed by the local school board and no
|
0012| more than five questions shall be developed by the staffs of
|
0013| each individual school site, provided that at least half of
|
0014| those questions are developed by teachers rather than
|
0015| administrators, in order to gather information that is
|
0016| specific to the particular community surveyed. The
|
0017| questionnaires shall indicate the public school site and shall
|
0018| be tabulated by the department of education within thirty days
|
0019| of receipt and shall be returned to the respective schools to
|
0020| be disseminated to all parents.
|
0021| [D.] F. The annual accountability report for
|
0022| each school district shall be adopted by the local school
|
0023| board, may be published no later than November 15 of each year
|
0024| and may be published at least once each school year in a
|
0025| newspaper of general circulation in the county where the
|

0001| school district is located. In publication, the report shall
|
0002| be titled "the school district report card" and disseminated
|
0003| in accordance with guidelines established by the state board
|
0004| to ensure effective communication with parents, students,
|
0005| educators, local policymakers and business and community
|
0006| organizations.
|
0007| [E.] G. The department of education shall
|
0008| create an accountability data system through which data from
|
0009| each public school and each school district may be compiled
|
0010| and reviewed. The department of education shall provide the
|
0011| resources to train school district personnel in the use of the
|
0012| accountability data system.
|
0013| [F.] H. The department of education shall
|
0014| verify data submitted by the school districts.
|
0015| [G.] I. The state board shall measure the
|
0016| performance of every public school in New Mexico. Public
|
0017| schools achieving the highest level of performance shall be
|
0018| eligible for supplemental incentive funding. The state board
|
0019| shall establish the corrective actions and interventions
|
0020| necessary for public schools whose performance level is low."
