0011|     RELATING TO STATE PROPERTY; AUTHORIZING A COUNTY REFERENDUM ON

0012|     THE TRANSFER OF CERTAIN STATE PROPERTY; DECLARING AN
    |
0013|     EMERGENCY.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1. TRANSFER OF LOS LUNAS MEDICAL CENTER-- 
    |
0017|     AUTHORIZING A COUNTY REFERENDUM.--
    |
0018|               A.  The board of county commissioners of a
    |
0019|     qualified county shall within ninety days following the
    |
0020|     effective date of this act:
    |
0021|                    (1)  adopt a resolution calling for an
    |
0022|     election to place on the ballot the question "Shall the
    |
0023|     legislature transfer the Los Lunas medical center to the Los
    |
0024|     Lunas school district for a price not to exceed one hundred
    |
0025|     thousand dollars ($100,000)?";

0001|                    (2)  arrange for the election to be held
    |
0002|     within sixty days following the date on which the resolution
    |
0003|     is adopted; and 
    |
0004|                    (3)  ensure that the election is called,
    |
0005|     conducted, counted and canvassed in the manner provided by law
    |
0006|     for elections within the county.
    |
0007|               B.  If a majority of the registered qualified
    |
0008|     electors voting on the question votes to transfer the Los
    |
0009|     Lunas medical center to the Los Lunas school district, then
    |
0010|     the legislature shall authorize by joint resolution the
    |
0011|     transfer of the Los Lunas medical center and all its 
    |
0012|     associated real property to the Los Lunas school district in
    |
0013|     the next regular session of the legislature.
    |
0014|               C.  As used in this section "qualified county"
    |
0015|     means a class B county with a population of greater than
    |
0016|     forty-five thousand people but less than forty-seven thousand,
    |
0017|     as determined by the 1990 federal decennial census.
    |
0018|          Section 2.  EMERGENCY.--It is necessary for the public
    |
0019|     peace, health and safety that this act take effect
    |
0020|     immediately.
