0012| CREATING A JOINT INTERIM LEGISLATIVE SUBDIVISION IMPACT REVIEW
|
0013| COMMITTEE; MAKING AN APPROPRIATION; DECLARING AN EMERGENCY.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. SUBDIVISION IMPACT REVIEW COMMITTEE CREATED--
|
0017| TERMINATION.--The "subdivision impact review committee" is
|
0018| created as a joint interim legislative committee. The
|
0019| committee shall function from the date of its appointment
|
0020| until December 1 prior to the first session of the forty-
|
0021| fourth legislature.
|
0022| Section 2. MEMBERSHIP--APPOINTMENT--VACANCIES.--
|
0023| A. The subdivision impact review committee shall
|
0024| be composed of eight members. The New Mexico legislative
|
0025| council shall appoint four members from the house of
|

0001| representatives and four members from the senate. At the time
|
0002| of making the appointment, the legislative council shall
|
0003| designate the chairman and vice chairman of the committee.
|
0004| B. Members shall be appointed from each house so
|
0005| as to give the two major political parties in each house the
|
0006| same proportionate representation on the subdivision impact
|
0007| review committee as prevails in each house; however, in no
|
0008| event shall either party have less than one member from each
|
0009| house on the committee. At the request of the committee
|
0010| chairman, members may be removed from the committee by the New
|
0011| Mexico legislative council for nonattendance according to
|
0012| council policy. Vacancies on the committee, however caused,
|
0013| may be filled by the legislative council, or the council may
|
0014| reduce the size of the committee by not making replacement
|
0015| appointments and in such case need not readjust party
|
0016| representation.
|
0017| C. No action shall be taken by the subdivision
|
0018| impact review committee if a majority of the total membership
|
0019| from either house on the committee rejects such action.
|
0020| Section 3. DUTIES.--After its appointment, the
|
0021| subdivision impact review committee shall hold one
|
0022| organizational meeting to develop a work plan and budget for
|
0023| the ensuing interim. The work plan and budget shall be
|
0024| submitted to the New Mexico legislative council for approval.
|
0025| Upon approval of the work plan and budget by the legislative
|

0001| council, the committee shall examine the statutes,
|
0002| constitutional provisions, regulations and court decisions
|
0003| governing subdivision in New Mexico and recommend legislation
|
0004| or changes if any are found to be necessary to the first
|
0005| session of the forty-fourth legislature.
|
0006| Section 4. SUBCOMMITTEES.--Subcommittees shall be
|
0007| created only by majority vote of all members appointed to the
|
0008| subdivision impact review committee and with the prior
|
0009| approval of the New Mexico legislative council. A
|
0010| subcommittee shall be composed of at least one member from the
|
0011| senate and one member from the house of representatives, and
|
0012| at least one member of the minority party shall be a member of
|
0013| the subcommittee. All meetings and expenditures of a
|
0014| subcommittee shall be approved by the full committee in
|
0015| advance of such meeting or expenditure, and the approval shall
|
0016| be shown in the minutes of the committee.
|
0017| Section 5. REPORT.--The subdivision impact review
|
0018| committee shall make a report of its findings and
|
0019| recommendations for the consideration of the first session of
|
0020| the forty-fourth legislature. The report and suggested
|
0021| legislation shall be made available to the New Mexico
|
0022| legislative council on or before December 15 preceding that
|
0023| session.
|
0024| Section 6. STAFF.--The staff for the subdivision impact
|
0025| review committee shall be provided by the legislative council
|

0001| service.

0002| Section 7. APPROPRIATION.--Twenty thousand dollars
|
0003| ($20,000) is appropriated from the general fund to the
|
0004| legislative council service for expenditure in fiscal year
|
0005| 1999 for the purpose of paying the salaries and expenses of
|
0006| the technical, legal, clerical and stenographic assistants,
|
0007| for necessary equipment and supplies used in carrying out the
|
0008| provisions of this act and for reimbursing the per diem and
|
0009| mileage expenses of the subdivision impact review committee.
|
0010| Any unexpended or unencumbered balance remaining at the end of
|
0011| fiscal year 1999 shall revert to the general fund. Payments
|
0012| from the appropriation shall be made upon vouchers signed by
|
0013| the director of the legislative council service or his
|
0014| authorized representative.
|
0015| Section 8. EMERGENCY.--It is necessary for the public
|
0016| peace, health and safety that this act take effect
|
0017| immediately.
