0011| RELATING TO FEES; INCREASING THE AMOUNT OF THE TRAFFIC SAFETY

0012| FEE; AMENDING SECTIONS OF THE NMSA 1978; MAKING AN
|
0013| APPROPRIATION.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 35-6-1 NMSA 1978 (being Laws 1968,
|
0017| Chapter 62, Section 92, as amended by Laws 1997, Chapter 242,
|
0018| Section 3 and also by Laws 1997, Chapter 247, Section 1) is
|
0019| amended to read:
|
0020| "35-6-1. MAGISTRATE COSTS--SCHEDULE--DEFINITION OF
|
0021| "CONVICTED".--
|
0022| A. Magistrate judges, including metropolitan court
|
0023| judges, shall collect the following costs:
|
0024| Docket fee, criminal actions under Section 29-5-1 NMSA
|
0025| 1978 . . . . . . . . . . . . . . . . . . . . . $ 1.00

0001| Docket fee, to be collected prior to docketing any other
|
0002| criminal action, except as provided in Subsection B
|
0003| of Section 35-6-3 NMSA 1978. . . . . . . . . . 20.00

0004| Docket fee, ten dollars ($10.00) of which shall be
|
0005| deposited in the court automation fund, to be
|
0006| collected prior to docketing any civil action, except
|
0007| as provided in Subsection A of Section 35-6-3 NMSA

0009| Jury fee, to be collected from the party demanding trial
|
0010| by jury in any civil action at the time the demand is

0015| Copying fee, for computer-generated or electronically

0017| Proceeds from this copying fee shall be transferred
|
0018| to the administrative office of the courts for
|
0019| deposit in the court automation fund. Except as
|
0020| otherwise specifically provided by law, docket fees
|
0021| shall be paid into the general fund.
|
0022| B. Except as otherwise provided by law, no other
|
0023| costs or fees shall be charged or collected in the magistrate
|
0024| or metropolitan court.
|
0025| C. The magistrate or metropolitan court may grant
|

0001| free process to any party in any civil proceeding or special
|
0002| statutory proceeding upon a proper showing of indigency. The
|
0003| magistrate or metropolitan court may deny free process if it
|
0004| finds that the complaint on its face does not state a cause of
|
0005| action.
|
0006| D. As used in this subsection, "convicted" means
|
0007| the defendant has been found guilty of a criminal charge by
|
0008| the magistrate or metropolitan judge, either after trial, a
|
0009| plea of guilty or a plea of nolo contendere. Magistrate
|
0010| judges, including metropolitan court judges, shall collect the
|
0011| following costs:
|
0012| (1) corrections fee, to be collected upon
|
0013| conviction from persons convicted of violating any provision
|
0014| of the Motor Vehicle Code involving the operation of a motor
|
0015| vehicle, convicted of a crime constituting a misdemeanor or a
|
0016| petty misdemeanor or convicted of violating any ordinance that
|
0017| may be enforced by the imposition of a term of imprisonment
|

0019| (2) court automation fee, to be collected
|
0020| upon conviction from persons convicted of violating any
|
0021| provision of the Motor Vehicle Code involving the operation of
|
0022| a motor vehicle, convicted of a crime constituting a

0023| misdemeanor or a petty misdemeanor or convicted of violating
|
0024| any ordinance that may be enforced by the imposition of a term
|
0025| of imprisonment . . . . . . . . . . . . . . . . . . . 10.00;

0001| (3) traffic safety fee, to be collected upon
|
0002| conviction from persons convicted of violating any provision
|
0003| of the Motor Vehicle Code involving the operation of a motor
|

0005| (4) judicial education fee, to be collected
|
0006| upon conviction from persons convicted of operating a motor
|
0007| vehicle in violation of the Motor Vehicle Code, convicted of a
|
0008| crime constituting a misdemeanor or a petty misdemeanor or
|
0009| convicted of violating any ordinance punishable by a term of
|
0010| imprisonment . . . . . . . . . . . . . . . . . . . . . 1.00;

0011| and
|
0012| (5) brain injury services fee, to be
|
0013| collected upon conviction from persons convicted of violating
|
0014| any provision of the Motor Vehicle Code involving the
|
0015| operation of a motor vehicle . . . . . . . . . . . . . 5.00.

0016| E. Metropolitan court judges shall collect as
|
0017| costs a mediation fee not to exceed five dollars ($5.00) for
|
0018| the docketing of small claims and criminal actions specified
|
0019| by metropolitan court rule. Proceeds of the mediation fee
|
0020| shall be deposited into the metropolitan court mediation
|
0021| fund."
|
0022| Section 2. Section 66-8-116.3 NMSA 1978 (being Laws
|
0023| 1989, Chapter 320, Section 5, as amended by Laws 1997, Chapter
|
0024| 242, Section 5 and also by Laws 1997, Chapter 247, Section 2)
|
0025| is amended to read:

0001| "66-8-116.3. PENALTY ASSESSMENT MISDEMEANORS--ADDITIONAL
|
0002| FEES.--In addition to the penalty assessment established for
|
0003| each penalty assessment misdemeanor, there shall be assessed:
|
0004| A. ten dollars ($10.00) to help defray the costs
|
0005| of local government corrections;
|
0006| B. a court automation fee of ten dollars ($10.00);
|
0007| C. a traffic safety fee of [three dollars
|
0008| ($3.00)] five dollars ($5.00), which shall be credited to
|
0009| the traffic safety education and enforcement fund;
|
0010| D. a judicial education fee of one dollar ($1.00),
|
0011| which shall be credited to the judicial education fund; and
|
0012| E. a brain injury services fee of five dollars
|
0013| ($5.00), which shall be credited to the brain injury services
|
0014| fund."
|
0015| Section 3. EFFECTIVE DATE.--The effective date of the
|
0016| provisions of this act is July 1, 1998.
