0011|     RELATING TO CRIMINAL LAW; CREATING A NEW CRIMINAL OFFENSE

0012|     KNOWN AS THEFT OF IDENTITY; PRESCRIBING PENALTIES; ENACTING A

0013|     NEW SECTION OF THE CRIMINAL CODE.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  A new section of the Criminal Code is enacted
    |
0017|     to read:
    |
0018|          "[<u>NEW MATERIAL</u>] THEFT OF IDENTITY.--
    |
0019|               A.  Theft of identity consists of a person who
    |
0020|     willfully obtains personal identifying information of another
    |
0021|     person without the authorization of that person and who uses
    |
0022|     the information to obtain credit, goods or services in the
    |
0023|     name of that other person, without the consent of that person.
    |
0024|               B.  As used in this section, "personal identifying
    |
0025|     information" means a person's name, address, telephone number,
    |

0001|     driver's license number, social security number, place of
    |
0002|     employment, employee identification number, demand deposit
    |
0003|     account number, savings account number or credit card number.
    |
0004|               C.  Whoever commits theft of identity is guilty of
    |
0005|     a misdemeanor."

0006|          Section 2.  EFFECTIVE DATE.--The effective date of the
    |
0007|     provisions of this act is July 1, 1998.
