0013| COORDINATING COUNCIL; PROVIDING DUTIES; PROVIDING STAFF;
|
0014| MAKING APPROPRIATIONS; DECLARING AN EMERGENCY.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. SHORT TITLE.--This act may be cited as the
|
0018| "Strategic Planning Coordinating Council Act".
|
0019| Section 2. FINDINGS AND PURPOSE.--
|
0020| A. The legislature finds that it is important to
|
0021| provide the highest quality elementary and secondary education
|
0022| in New Mexico to develop in students the knowledge and skills
|
0023| necessary for responsible citizenship, productive employment
|
0024| and satisfying lives.
|
0025| B. The legislature finds that the mission of
|

0001| public education is best accomplished by implementing the
|
0002| objectives and achieving the goals outlined in the strategic
|
0003| plan.
|
0004| C. The legislature finds that involving all
|
0005| branches of government and the public in the educational
|
0006| process will achieve widespread understanding of and support
|
0007| for the strategic plan.
|
0008| D. It is the purpose of the Strategic Planning
|
0009| Coordinating Council Act to establish a process to ensure the
|
0010| continuous enhancement and implementation of the strategic
|
0011| plan pursuant to the Strategic Planning for Public Education
|
0012| Act by:
|
0013| (1) evaluating results, including the annual
|
0014| assessment, review and revision of the strategic plan;
|
0015| (2) integrating the school districts' current
|
0016| budget activities by using both the budget cycle and
|
0017| educational plan for student success to implement the
|
0018| strategic plan; and
|
0019| (3) encouraging the three branches of
|
0020| government and the public to work together toward New Mexico's
|
0021| mission of public education.
|
0022| Section 3. DEFINITIONS.--As used in the Strategic
|
0023| Planning Coordinating Council Act:
|
0024| A. "council" means the strategic planning
|
0025| coordinating council; and
|

0001| B. "strategic plan" means the New Mexico public
|
0002| education strategic plan developed pursuant to the Strategic
|
0003| Planning for Public Education Act.
|
0004| Section 4. STRATEGIC PLAN.--The strategic plan shall
|
0005| provide:
|
0006| A. a well-defined vision and articulated steps to
|
0007| achieve national preeminence in education;
|
0008| B. a means to gain statewide consensus by
|
0009| encouraging the legislature, the governor's office, related
|
0010| state agencies, the state board of education, the state
|
0011| department of public education, the local school boards,
|
0012| school personnel, parents, students, the business community
|
0013| and school districts to work together toward the common goal
|
0014| of improving educational opportunities and performance of all
|
0015| the children of New Mexico; and
|
0016| C. coordination of the state-level planning cycle
|
0017| with the budgeting cycle.
|
0018| Section 5. STRATEGIC PLANNING COORDINATING COUNCIL.--
|
0019| A. The "strategic planning coordinating council"
|
0020| is created.
|
0021| B. The council shall be composed of fifteen
|
0022| members. The members shall be representative of the different
|
0023| geographical areas of the state and reflective of the diverse
|
0024| population of the state.
|
0025| C. The president pro tempore of the senate shall
|

0001| appoint two members from the senate and the speaker of the
|
0002| house shall appoint two members from the house of
|
0003| representatives for terms of two years or less to coincide
|
0004| with their terms of office.
|
0005| D. Eleven members shall be appointed as follows:
|
0006| (1) the president of the state board of
|
0007| education shall appoint one member for a two-year term and one
|
0008| member for a four-year term;
|
0009| (2) the governor shall appoint two members
|
0010| for two-year terms and one member for a four-year term; and
|
0011| (3) the governor, the speaker of the house,
|
0012| the president pro tempore of the senate and the president of
|
0013| the state board of education shall jointly appoint three
|
0014| members for two-year terms and three members for four-year
|
0015| terms.
|
0016| E. After the initial appointments, members who are
|
0017| not legislators shall be appointed for four-year terms, and
|
0018| members who are legislators shall be appointed for terms of
|
0019| two years or less to coincide with their terms of office.
|
0020| F. Members of the council, except for members who
|
0021| are legislators, may be reimbursed as provided in the Per Diem
|
0022| and Mileage Act and shall receive no other compensation,
|
0023| perquisite or allowance.
|
0024| Section 6. DUTIES.--The council shall:
|
0025| A. make recommendations to the legislature, the
|

0001| governor and the state board of education for the enhancement
|
0002| and implementation of the strategic plan and for the
|
0003| development of the priorities to be implemented yearly;
|
0004| B. make recommendations to the legislature, the
|
0005| governor and the state board of education for the development
|
0006| of a variety of formal and informal mechanisms to involve the
|
0007| public in this process;
|
0008| C. review the planning efforts conducted by the
|
0009| school districts and make recommendations to the legislature,
|
0010| the governor and the state board of education on the
|
0011| evaluation and revision of the strategic plan in response to
|
0012| public input;
|
0013| D. direct staff in the development of
|
0014| recommendations of proposed revisions of the strategic plan;
|
0015| E. submit the revised strategic plan to the
|
0016| legislative education study committee, the office of the
|
0017| governor and the state board of education with an analysis of
|
0018| the new priorities, including cost of implementation,
|
0019| recommendations regarding necessary legislation for
|
0020| implementation of the goals and objectives of the strategic
|
0021| plan and a recommended annual budget for the council's
|
0022| activities; and
|
0023| F. report at least annually to the legislature,
|
0024| the governor, the state board of education and the public on
|
0025| the progress in achieving and implementing the goals and
|

0001| objectives of the strategic plan.
|
0002| Section 7. STAFF MANAGEMENT TEAM--DUTIES.--The council
|
0003| shall be staffed by a staff management team composed of three
|
0004| staff members. The director of the legislative education
|
0005| study committee staff, the superintendent of public
|
0006| instruction and the office of the governor shall each
|
0007| designate a staff member to work with the council. The staff
|
0008| shall assist the council in carrying out its duties and shall
|
0009| serve as liaison to their appointing agencies.
|
0010| Section 8. ADMINISTRATION.--The legislative education
|
0011| study committee, in cooperation with the state board of
|
0012| education and the governor's office, shall be the
|
0013| administrative agency for the council. The legislative
|
0014| education study committee, in consultation with the state
|
0015| board of education and the governor's office, may contract for
|
0016| strategic planning assistance.
|
0017| Section 9. APPROPRIATION.--Seventy thousand dollars
|
0018| ($70,000) is appropriated from the general fund to the state
|
0019| department of public education for expenditure in fiscal years
|
0020| 1998 and 1999 for the purpose of funding personnel for the
|
0021| staff management team of the strategic planning coordinating
|
0022| council. Any unexpended or unencumbered balance remaining at
|
0023| the end of fiscal year 1999 shall revert to the general fund.
|
0024| Section 10. APPROPRIATION.--Seventy thousand dollars
|
0025| ($70,000) is appropriated from the general fund to the
|

0001| department of finance and administration for expenditure in
|
0002| fiscal years 1998 and 1999 for the purpose of funding
|
0003| personnel for the staff management team of the strategic
|
0004| planning coordinating council. Any unexpended or unencumbered
|
0005| balance remaining at the end of fiscal year 1999 shall revert
|
0006| to the general fund.
|
0007| Section 11. APPROPRIATION.--Eighty-two thousand dollars
|
0008| ($82,000) is appropriated from the general fund to the
|
0009| legislative education study committee for expenditure in
|
0010| fiscal years 1998 and 1999 for the purpose of funding
|
0011| personnel for the staff management team of the strategic
|
0012| planning coordinating council and for the purpose of paying
|
0013| per diem and travel expenses for members of the strategic
|
0014| planning coordinating council. Any unexpended or unencumbered
|
0015| balance remaining at the end of fiscal year 1999 shall revert
|
0016| to the general fund.
|
0017| Section 12. EMERGENCY.--It is necessary for the public
|
0018| peace, health and safety that this act take effect
|
0019| immediately.
